According to the 2024 Land Law and its implementing guidelines, the land price list issued by the provincial People's Committee according to current regulations will continue to be applied until December 31, 2025.
This is the basis for determining financial obligations regarding land when the land user carries out procedures for granting a Land Use Rights Certificate (red book).
From January 1, 2026, the 2024 Land Law stipulates that the land price list will be developed and adjusted annually according to the principle of approaching market prices. The new land price list continues to be used as a basis for calculating land use fees, land rents, registration fees and land-related revenues.
In that context, completing the procedures for making a red book before December 31, 2025 helps land users stabilize their financial obligations.
In which:
- Land use fees in cases where the State recognizes residential land use rights, allocates land with fees or permits change of land use purpose determined according to the current land price list, not affected by the mechanism of adjusting land price lists according to new regulations.
- Registration fee when registering land use rights and house ownership rights is also calculated according to the current land price list. The early issuance of red books helps land users proactively cover costs, limiting the arising of higher financial obligations when the new land price list is issued.
Making a red book before this time also helps complete all legal documents on land, creating a basis for land users to exercise the rights according to regulations such as transfer, mortgage, inheritance or registration of changes when there are changes.
However, the law also clearly stipulates that financial obligations are determined according to the time the competent state agency issues the payment notice, not only based on the time of submission of the application. Therefore, land users need to monitor the progress of file settlement to ensure their rights according to regulations.
According to current legal regulations, making a red book before December 31, 2025 helps land users be proactive in costs and complete legal documents, in the context of the land price list mechanism that will change from 2026.
