Cost of making a red book
For the first time, people will have to pay fees such as: Land use fees, registration fees, certificate issuance fees, and file appraisal fees.
In particular, the certificate issuance fee will be decided by the Provincial People's Council, according to Clause 5, Article 3 of Circular 85/2019/TT-BTC. Therefore, the fee for granting red books will be different, depending on the locality.
For example, in Hanoi, the fee for issuing red books for the first time is stipulated in Resolution 06/2020/NQ-HDND. If individuals and households only have the right to use land (without houses and assets), the fee is 25,000 VND/paper in wards in inner-city districts of Hanoi; 10,000 VND/ paper in other areas.
Individuals and households with land use rights, house ownership rights and other assets attached to land: VND 100,000/paper in wards under the district; VND 50,000/paper in other areas.
Registration fee
According to the provisions of Decree 10/2022/ND-CP and Circular 13/2022/TT-BTC, the registration fee payable for real estate when registering land use rights and house ownership rights is 0.5%.
Formula for calculating the registration fee payable = 0.5% x (Pricet of 1m2 of land in the Land Price List x Area granted a certificate).
Document appraisal fee
The fee for appraisal of documents for granting Land Use Rights Certificates is the fee for appraisal of documents, necessary and sufficient conditions to ensure the issuance of Certificates of land use rights, house ownership rights and assets attached to land (including initial issuance, issuance of new Certificates and re-issuance of certificates of changes to issued Certificates) according to the provisions of law, according to Point b, Clause 3, Article 1 of Circular 106/2021/TT-BTC.
Thus, this amount is regulated by the Provincial People's Council. Therefore, this amount can be collected or exempted in other provinces and cities.
Land use fee
Cases that require payment of land use fees include: Residential land without legal documents on land use rights; land used after October 15, 1993 but not yet paid to the State; garden land, ponds in the same plot of land with houses but not yet recognized as residential land; encroached, occupied land but eligible for consideration for granting a certificate; conversion of land use purposes from other land to residential land.
The method of calculating the fee in these cases is as follows:
In case of residential land with a house before October 15, 1993 (lack of documents), people pay 50% of the land use fee.
In case of residential land used after October 15, 1993, people pay 100% of land use fees
In case garden land and ponds are converted to residential land, people pay the difference between residential land prices and agricultural land prices.
