Area of land division for agricultural land in Khanh Hoa
Reader Nguyen Thi Huong sent a question to Lao Dong Newspaper questioning the minimum area when dividing agricultural land plots in Khanh Hoa. According to current regulations, the conditions, size and minimum area for land division and consolidation in Khanh Hoa province are implemented according to Decision 29/2024/QD-UBND.
According to Clause 3, Article 6 of Decision 29/2024/QD-UBND, the minimum area for land division for agricultural land in Khanh Hoa province is stipulated as follows:
- For annual crop land, salt production land, aquaculture land: 500 m2.
- For perennial land: 500 m2 (urban area) and 1,000 m2 (rural area).
- For production forest land, protective forest land: 5,000 m2.
- For other types of agricultural land: 500 m2.
In addition, other regulations on conditions for dividing agricultural land plots are also clearly stated:
In case the agricultural land plot is located in an area not subject to agricultural land planning and is not recovered according to the land use plan, the land user is allowed to separate the plot according to the minimum area or must change the purpose of use according to the planning before dividing the plot.
In case the agricultural land plot is located between residential areas, the minimum area allowed for division is 200 m2, with a minimum frontage width and depth of the land plot of 5 m.

Regulations on land division areas for non-agricultural land
According to Clause 4, Article 6 of Decision 29/2024/QD-UBND, the regulation on land division for non-agricultural production and business land and other non-agricultural land is implemented as follows:
The division of the plot must be based on the zoning plan, detailed urban and rural planning, detailed construction planning (1500 scale) and the approved land use plan.
In case of separation of commercial and service land plots in areas without detailed urban planning, the separation of plots must comply with the provisions of Point a, Clause 2, Article 6 of the Decision.
Some notes when implementing land division
In addition to general regulations, Decision 29/2024/QD-UBND also mentions a number of special cases:
For land plots with many special edges and shapes, if the minimum area is guaranteed but does not meet the requirements for edge size, the Director of the District Land Registration Office Branch must report to the Director of the Provincial Land Registration Office to consider each specific case.
Decision 29/2024/QD-UBND takes effect from November 10, 2024, and replaces:
Decision 28/2022/QD-UBND of Khanh Hoa Provincial People's Committee on regulations on land allocation limits, recognition of land use rights, conditions for land division and minimum area for land division for each type of land.
Decision 02/2024/QD-UBND of Khanh Hoa Provincial People's Committee on amending and supplementing a number of contents of Decision 28/2022/QD-UBND.
With the issuance of Decision 29/2024/QD-UBND, Khanh Hoa province expects to manage land division more closely, ensuring sustainable development and compliance with general planning in the province.
