Method of agricultural land concentration
Article 192 of the 2024 Land Law stipulates the concentration of agricultural land as follows:
+ Converting agricultural land use rights according to the plan of consolidating land plots and exchanging plots.
+ Lease of land use rights.
+ Cooperation in production and business using land use rights.
Principles of agricultural land concentration
+ Ensure publicity, transparency, voluntariness, democracy, fairness.
+ Ensure the legitimate rights and interests of the State, land users and related organizations and individuals; do not affect national defense and security.
+ Comply with the provisions of the law on land, civil law and other relevant legal provisions; in accordance with the planning and land use plan approved by competent authorities.
Concentrating agricultural land in accordance with land and terrain
In accordance with the characteristics of land, terrain, climate, culture, labor shift, job conversion, rural employment in each region, each area, each locality and in line with market demand.
The State encourages the implementation of agricultural centralism
The State has policies to encourage individuals and organizations to focus on agricultural production; apply science and technology to use the concentrated land fund economically and effectively.
Funding for land measurement, adjustment of cadastral records, issuance of red books for land to carry out land consolidation and plot exchange to concentrate land for agricultural production is guaranteed by the State budget.
There is a clear plan to concentrate agricultural land
Economic organizations and individuals implementing agricultural land concentration must develop a land use plan and send it to the People's Committees (PCs) at the commune level for monitoring.
In case the land use plan changes the land use purpose within the agricultural land group, it must negotiate with the land user about the return of agricultural land after participating in land concentration. In case of concentrating agricultural land and having to adjust land use rights, it shall be implemented in accordance with the provisions of Article 219 of the 2024 Land Law.
- People's Committees at all levels are responsible for propagating, disseminating policies and laws, guiding and supporting all parties in implementing agricultural land concentration, ensuring stable planning for concentrated agricultural land areas.
