Mr. Lo Cam Hong (Son La province) reflected questions related to the procedures for implementing construction projects in urgent cases. According to him, for projects under the provisions of point a, clause 1, Article 130 of the 2014 Construction Law, which was amended and supplemented in 2020, do investors have to carry out appraisal procedures at specialized construction agencies and submit projects for approval before proceeding with construction?
Answering this content, the Ministry of Construction said that the provisions in point a, clause 1, Article 130 of the Construction Law have been detailed in Article 69 of Decree No. 175/2024/ND-CP of the Government on management of construction activities.

According to the provisions of the above decree, for urgent construction projects, the law does not set the requirement to carry out the appraisal step of the specialized construction agency as well as the project approval procedure before deploying construction.
This means that projects in emergencies will be organized and implemented according to their own procedures, in order to meet the requirements of timely handling of urgent situations. Construction is carried out according to the procedures specified in Article 69 of Decree No. 175/2024/ND-CP.
The Ministry of Construction requests people and related organizations to study current legal regulations to implement them in the correct order for urgent construction projects.
