According to Lao Dong, after August 1, 2024, from the date of full payment for the house and being granted a red book, for selling social housing after 5 years, people will not have to pay land use fees, only have to pay income tax and other fees according to regulations.
Referring to this content, the Ministry of Construction said that according to Point d, Clause 5, Article 198 of the 2023 Housing Law (effective from August 1, 2024), in case of selling social housing that must pay land use fees before August 1, 2024 but has not yet paid, it must continue to be paid according to the old regulations.
This is also clearly stated in Clause 10, Article 78 of Decree 100/2024/ND-CP of the Government.
According to Point e, Clause 1, Article 89 of the Housing Law 2023, from August 1, 2024, if the buyer has paid the full amount and is granted a red book, after 5 years, he/she is allowed to resell the social housing (not individual housing) without having to pay land use fees.
Thus, in the case of selling social housing that has paid the full house purchase fee and was granted a certificate before August 1, 2024 but has not yet paid the land use fee, it will continue to be paid according to regulations before the effective date of this law.
After August 1, 2024, from the date of full payment of the house and issuance of the Certificate, the sale of social housing (not individual housing) after 5 years does not require payment of land use fees but must pay income tax and other payables.
At the same time, the reselling of this house will follow the market mechanism, complying with the law on real estate business and the law on land.
