Yesterday, September 16, the Ho Chi Minh City Tax Department urgently requested the Ho Chi Minh City People's Committee to organize a meeting to resolve land records from August 1, 2024. This is the third request from the Ho Chi Minh City Tax Department in the past month on this issue.
In this petition sent to the HCMC People's Committee, the HCMC Tax Department proposed that the HCMC People's Committee organize a meeting to resolve and unify the application of legal documents such as land price tables, land price adjustment coefficients, land rent calculation percentages, etc. so that tax authorities can promptly calculate financial obligations on land.
According to the proposal of the Ho Chi Minh City Tax Department, for land records arising from August 1, 2024 to before the date the Ho Chi Minh City People's Committee issued a decision to adjust the land price list, Decision No. 02 dated January 16, 2020 of the Ho Chi Minh City People's Committee on promulgating regulations on land price lists in the area for the period 2020 - 2024 shall apply.
It is known that from August 1, the 2024 Land Law takes effect, the K coefficient is no longer applied to determine land prices according to the price adjustment coefficient method, so the Ho Chi Minh City People's Committee must adjust the land price list accordingly, approaching the market price. The process of building the land price list must comply with the regulations on procedures according to the 2024 Land Law and Decree 71/2024/ND-CP, ensuring that the price is suitable for each area, location and actual situation in the locality.
Up to now, the draft of the adjusted land price list of the Ho Chi Minh City People's Committee has been widely consulted with organizations, agencies, land users... However, it is still not possible to reach an agreement and issue a final land price list. Therefore, administrative procedures and land records of people in the city are still stuck.
Not only individual investors, but also real estate businesses are tired of the story of land price lists. Many brokerage businesses selling at some projects in Thu Duc City, mainly land and apartments, are also having difficulty completing procedures to complete transactions. All documents submitted to the tax authorities are stuck, unable to pay taxes, and unable to carry out procedures to transfer ownership to customers.
According to information from the Ho Chi Minh City Tax Department, from August 1 to August 27, the unit received a total of 8,808 records. Of which, there were 346 records of land use fee collection in cases of land use right recognition, 277 records of land use fee collection in cases of land use purpose change, 5,448 records of personal income tax from real estate transfer and 2,737 records of cases where no financial obligations arise.
Recently, the Ministry of Natural Resources and Environment had a working session with a number of ministries, branches, the Ho Chi Minh City Real Estate Association (HoREA) and related parties to collect opinions and contributions to handle the difficulties of the Ho Chi Minh City People's Committee related to the application of land price list according to the 2024 Land Law.
Mr. Le Hoang Chau, Chairman of HoREA, said that at the end of the working session, 8,808 pending land records arising from August 1 to present in Ho Chi Minh City have been resolved. Accordingly, the tax authority will follow the principle of applying the law. The records received at which time will be considered and resolved according to the legal regulations in effect at that time.
Delegates attending the meeting also agreed that Ho Chi Minh City needs to urgently develop and promulgate an adjusted land price list to apply to 11 cases specified in Clause 1, Article 159 of the 2024 Land Law, contributing to promoting socio-economic development.
