Removing obstacles in land price list of Ho Chi Minh City

The Ministry of Natural Resources and Environment will chair a meeting to resolve issues regarding Ho Chi Minh City's land price list on September 10.

According to the Ministry of Natural Resources and Environment (MONRE), implementing the direction of Deputy Prime Minister Tran Hong Ha, on August 29, the ministry sent an official dispatch to agencies and units to research and contribute opinions on the problem of applying the land price list of the Ho Chi Minh City People's Committee.

The Ministry of Natural Resources and Environment will hold an interdisciplinary meeting to discuss and propose an optimal solution, based on a comprehensive and general assessment of the process of issuing land price lists in Ho Chi Minh City in the recent past to determine whether or not to adjust and how to adjust.

The Department of Natural Resources and Environment of Ho Chi Minh City has also sent an urgent document to the Ministry of Natural Resources and Environment, stating many issues regarding the adjustment of land price lists according to the provisions of the new Land Law.

According to the Department of Natural Resources and Environment of Ho Chi Minh City, Clause 1, Article 257 of the 2024 Land Law allows the Provincial People's Committee, if necessary, to decide to adjust the land price list to suit the actual situation of land prices in the locality.

At the same time, the Standing Committee of the Ho Chi Minh City Party Committee has chosen the option of developing an adjusted land price list applicable for the period from August 1, 2024 to December 31, 2025 in the city.

Ho Chi Minh City bases on the existing land price database filtered from sources such as: compensation land prices, resettlement land prices, specific prices approved by People's Committees at all levels, actual land transfer prices from land registration agencies, tax agencies to update and adjust the land price list.

According to the Department of Natural Resources and Environment of Ho Chi Minh City, this plan complies with the provisions of Clause 1, Article 257 of the 2024 Land Law and is consistent with the actual situation of land prices in Ho Chi Minh City. Therefore, the City People's Committee has decided to assign the Department of Natural Resources and Environment to develop a decision to adjust Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee regulating land prices in Ho Chi Minh City.

The Department of Natural Resources and Environment of Ho Chi Minh City also reported on the procedures and methods for building the adjusted land price list through 6 steps. Currently, the department is in the final step.

Currently, Ho Chi Minh City is facing difficulties and obstacles in resolving administrative procedures regarding financial obligations in the transition period from August 1, 2024 to the time the land price list is adjusted according to the provisions of Clause 1, Article 257 of the 2024 Land Law is issued.

Accordingly, from August 1, 2024, if the unadjusted land price table in Decision No. 02.2020 is applied without multiplying by the 2024 land price adjustment coefficient, it will not be suitable for the current actual land price conditions in the locality. If the unadjusted land price table in Decision No. 02 is continued to be applied multiplied by the 2024 land price adjustment coefficient, there will be no regulations guiding its implementation.

In fact, recently, in Ho Chi Minh City, there have been many cases of people coming to complete documents to change land use purposes and transfer land. However, when transferring to the tax authority to calculate tax and land use fees, it is stuck because there is no guidance, causing difficulties for people.

The Ho Chi Minh City Tax Department said that from August 1 to August 27, it received a total of 8,808 records. Of these, 346 were for land use fee collection in cases of land use right recognition, and 277 were for land use fee collection in cases of land use purpose change. In addition, there were 5,448 personal income tax records from real estate transfers and 2,737 records in cases where no financial obligations arose.

And these files are "stuck" because they are waiting for the Ho Chi Minh City People's Committee to issue a decision to adjust the land price list and provide guidance and direction on the application of legal documents (land price list, land price adjustment coefficient, percentage for calculating land rent...).
