What is 50 year land?
50-year land is a common term in practice to refer to land with a maximum term of use of 50 years, according to the provisions of land law in Vietnam. This is usually land allocated or leased for use for specific purposes such as agricultural production, forestry, aquaculture, farming, or implementing business investment projects.
In special cases (large-scale projects, investment in difficult areas), this period can be extended to 70 years.
Speaking with Lao Dong reporter, lawyer Truong Anh Tu (TAT Law Firm) said that according to the provisions of Article 80, Article 81, Article 172 of the 2024 Land Law, some cases of land recovery due to violations of land laws include:
Misuse of assigned purpose:
Land is not used for the purpose stated in the land allocation or lease decision and has been administratively sanctioned for using land for the wrong purpose and continues to violate (for example: agricultural land is illegally converted into residential land).
Do not put land into use:
Land for growing annual crops and aquaculture that has not been used for 12 consecutive months, land for growing perennial crops that has not been used for 18 consecutive months, land for growing forests that has not been used for 24 consecutive months and has been administratively sanctioned but the land has not been put into use within the time limit stated in the decision on administrative sanction.
Expiry of land use:
When the 50-year term expires, if there is no valid extension application, the land use right may be revoked for inclusion in land use planning.
Violation of land law:
Encroachment on land, land destruction and continued violations that have been administratively sanctioned for land destruction can all lead to land revocation.
Land acquisition for national purposes:
Land located in areas planned for development projects for national defense and security purposes; socio-economic development for national and public interests according to decisions of competent state agencies.
The lawyer also recommended that people pay attention to the fact that land with a 50-year term of use must be managed and used in accordance with regulations to avoid the risk of land repossession.
