Lam Dong Provincial People's Committee has just issued a decision regulating the conditions and minimum area for land separation and consolidation for each type of land.

On October 1, Mr. Tran Hong Thai - Chairman of Lam Dong Provincial People's Committee - signed a decision stipulating the conditions and minimum area for land division and land consolidation for each type of land in Lam Dong province, effective from October 15.

This Decision regulates the area of ​​land division for urban residential land, including townhouses that are divided when the area is 40m2 or more, the side adjacent to the road is over 4m; townhouses with gardens from 72m2 or more, the side adjacent to the road is over 4.5m; houses with gardens in alleys have an area of ​​64m2 or more, the side adjacent to the road is over 4m.

Detached houses with a land area of ​​250m2 or more, adjacent to a named road of over 10m. On remaining roads and alleys with a land area of ​​200m2 or more, adjacent to a road of over 10m; villas with a land area of ​​400m2 or more, adjacent to a named road of over 12m.

On remaining streets and alleys, the land area is 250m2 or more and the road adjacent side is over 10m.

In case of rural residential land without regulations on housing architecture, the residential land area must be over 72m2, the size of the land plot adjacent to public traffic roads or walkways must be over 4.5m.

For agricultural production land and other agricultural land, the minimum area for subdivision in urban areas is 500 m2 and in rural areas is 1,000 m2.

The plots of land after being divided must have a side size adjacent to an existing public road or walkway of over 10m. The minimum area for dividing a plot of production forest land is 10,000m2.

According to Lam Dong Provincial People's Committee, land to be separated or merged must ensure the principles and conditions stipulated in Clause 1, Article 220 of the Land Law and some other conditions such as: the land does not have a land recovery notice or land recovery decision from a competent state agency.

In case there is a notice of land reclamation but the area and boundaries of the land can be determined according to the notice of reclamation, the remaining area and boundaries of that land plot are still allowed to be separated or merged.
