Mr. N.V.T in Phu Tho proposed that competent authorities guide the handling of the following situation:
On September 30, 2004, the City People's Committee (old) issued the first red book to Ms. Dinh Thi Oanh's household.
Currently, Ms. Oanh requests to correct the issued red book on land user information from "Mrs. Dinh Thi Oanh's household" to "Dinh Thi Kim Oanh".
Ms. Oanh provided the red book in the name of Dinh Thi Oanh and the citizen identification card of Ms. Dinh Thi Kim Oanh.
However, Ms. Oanh could not provide documents proving information errors of the person granted the certificate compared to information at the time of requesting correction or information errors about land plots and assets attached to land compared to information on the issued certificate.
The Ward People's Committee has notified the branch of the land registration office to transfer the red book issuance dossier to the agency with land management functions, but the branch of the land registration office replied that it could not find the above red book issuance dossier.
According to the provisions in section 2, section 3, part XIV of part C of Part V of Appendix I attached to Decree No. 151/2025/ND-CP, the fact that land users cannot provide documents proving errors in information of the land use right certificate holder compared to information at the time of requesting correction or errors in information about land plots, assets attached to land compared to information on the issued land use right certificate; no issued land use right certificate dossier to check the dossier, make minutes of conclusions on the content and causes of errors, there is no basis to correct the issued land use right certificate.
Mr. T asked, for this case, what is the solution according to regulations?
The Ministry of Agriculture and Environment answers this question as follows:
Point a, Clause 1, Article 152 of the Land Law stipulates correcting a certificate issued with errors in the following cases:
There are errors in the information of the person granted the certificate compared to the information at the time of correction".
The order and procedures for correcting errors are implemented according to the provisions of point XIV of content C of Part V of Appendix I issued together with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization of authority of local authorities at 2 levels, decentralization, and decentralization in the field of land.
Based on the above regulations, if land users discover errors in the information of the person granted the certificate compared to the information at the time of requesting correction, they need to provide documents proving the error.
