The Ministry of Justice has just publicly disclosed the Appraisal Dossier for the draft Law on Housing (amended). In the document submitted for appraisal, the Ministry of Construction had a Report dated September 9 on summarizing the implementation of the Housing Law in 2023.
Regarding the development of rental housing, according to the Ministry of Construction, the types of rental housing in localities are very diverse, including social housing for rent, worker dormitories in industrial parks, student housing, old public housing, commercial housing for rent (apartments, boarding houses, mini-apartments... ).
According to reports from 21/34 localities on housing development for rent, as of June 2026, there are about 60,900 houses in rent nationwide. Including 25,450 social housing units, 11,750 worker dormitories in industrial parks, more than 9,000 student housing units and about 14,700 old public housing units in rent.
It is forecasted that by 2030, the demand for rental housing in localities has reported about 217,430 rental housing units. Of which, 88,080 social housing units for rent, 121,630 worker dormitories in industrial parks and 1,800 student housing units. In addition, according to aggregated data from localities sent to the Ministry of Construction as of June 2026, the total number of apartments for rent is 116,227 units, of which public investment capital/public assets is 75,142 units and private investment capital is 41,085 units. The total rental demand is 264,397 units, of which public investment capital/public assets is 145,772 units and private investment capital is 118,625 units.
To develop this type, the draft revised Housing Law has added a new chapter regulating rental housing.
For rental housing invested and built with state capital, the draft stipulates the subjects eligible to rent housing. In case the number of registered tenants exceeds the number of houses, priority consideration is carried out in the following order: people with meritorious services to the revolution, relatives of martyrs; people with disabilities; elderly people; households with houses recovered or demolished but not yet arranged for resettlement; experts and scientists entitled to housing incentives according to the provisions of the law on science, technology and innovation; people with 2 or more children; other priority subjects specified by the provincial-level People's Committee based on the actual conditions of the locality.
Regarding the State's support policy for housing construction investment projects for rent, for investment projects built with capital from the local Housing Fund, a part of the floor area for business services and commerce of the project is reserved for rent to generate revenue to serve the management, operation, maintenance, and repair of the project.
The State budget subsidizes the management and operation of houses in cases where rent, floor rental fees for business services and commerce in the project and other legal revenues are not sufficient to cover costs.
Regarding the management and use of rental housing, investors shall implement stable and long-term rental housing based on agreement through a housing lease contract. The rental price for projects invested in construction with capital from the Housing Fund is determined on the principle of fully calculating the cost of recovering investment capital for building rental housing, housing maintenance costs, taxes, fees, and charges as prescribed.
The draft also stipulates revenue and expenditure sources for management and operation; investment capital recovery sources for construction investment projects using capital from the local Housing Fund; principles for using revenue from housing rent, rent from floor area for business services, commerce and management and operation units.
