Decree 339/2026/ND-CP stipulates penalties for violations of construction order, including construction without a construction permit.

The Government promulgates Decree No. 339/2026/ND-CP stipulating penalties for administrative violations in the fields of construction, management of technical infrastructure works, management, housing development, and real estate business. This Decree takes effect from August 26, 2026.

In which, Clauses 6,7 Article 25 stipulate the level of penalties for violations of construction order regulations by investors, including violations of construction permits. Specifically:

Article 25. Violations of investors regarding construction order

... 6. Sanctions for the act of organizing construction of works not in accordance with the content of the issued construction permit for cases of issuing new construction permits are as follows:

a) A fine of between 30,000 VND and 40,000 VND shall be imposed for the construction of individual houses, except for the cases specified in point b of this clause;

b) A fine of between 500,000 VND and 70,000 VND shall be imposed for the construction of individual houses in the protected area I of the relic, world heritage area, protected area II of the relic, buffer zone of the world heritage area or other construction works;

c) A fine of between 100,000,000 VND and 120,000,000 VND shall be imposed for construction works that must prepare an economic - technical report;

d) A fine of between 120,000,000,000 VND and 140,000,000,000 VND shall be imposed for the construction of works that must prepare a Feasibility Study Report.

7. Sanctions for the act of organizing construction of works that have not been granted a construction permit but are required to have a construction permit as follows:

a) A fine of between 60,000,000 VND and 80,000,000 VND shall be imposed for the construction of individual houses, except for the cases specified in point b of this clause;

b) A fine of between 80,000 VND and 100,000 VND shall be imposed for the construction of individual houses in the protected area I of the relic, world heritage area, protected area II of the relic, buffer zone of the world heritage area or other construction works;

c) A fine of between 120,000,000,000 VND and 140,000,000,000 VND shall be imposed for the construction of works that must prepare an economic - technical report;

d) A fine of between VND 140,000,000,000 and VND 160,000,000,000 shall be imposed for the construction of works that must prepare a Feasibility Study Report.
