On the Government Portal, Ms. P.T.P in Hanoi asked, based on Point d, Clause 1, Article 79 of the Housing Law 2023, 5 groups of subjects are given priority to buy social housing in addition to 12 subjects are allowed to buy social housing, including: People with revolutionary contributions; relatives of martyrs; people with disabilities; people who are arranged for resettlement in the form of buying or renting social housing; women.
In case a subject is entitled to many different support policies, he/she is entitled to one policy with the highest support level. In case there are many subjects that meet the standards and conditions for purchasing social housing, the investor will consider approving according to the above priority order.
Ms. P.TP asked how the female subject in this case was understood? Are it women - the only group eligible to buy social housing in general, or single women, or women whose members are other priority groups (people with revolutionary contributions, Vietnamese Heroic Mothers, relatives of martyrs, people with disabilities, people being resettled);
The Ministry of Construction responds to this issue as follows:
At Point d, Clause 1, Article 79 of the Housing Law 2023, it is stipulated that: "... in case the subjects have the same standards and conditions, support will be implemented in order of priority for: people with revolutionary contributions, relatives of martyrs, people with disabilities, people who are arranged for resettlement in the form of buying or renting social housing, women".
Clause 2, Article 38 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing stipulates:
"... The list of priority groups is arranged in order according to the time of application submission. Apartments for priority subjects are arranged in order of priority list until sold out, the remaining subjects are allowed to continue participating in the draw".
Articles 29 and 30 of Decree No. 100/2024/ND-CP specifically stipulate housing conditions and income of social housing buyers in both cases where the buyer is single and the buyer is married according to the provisions of law.
Form No. 01 of Appendix II of Decree No. 100/2024/ND-CP stipulates the Application for registration of purchase, hire-purchase, and hire-purchase of social housing. In which, the content of declaring the information of the petitioner includes the following contents:
"They and the name of the petitioner"...
"I have a monthly income of...";
"I have not been able to buy or rent social housing, and have not enjoyed any housing support policies in any form in the province or centrally-run city where there is a social housing construction investment project. I would like to guarantee that the statements in the petition are true and that I am fully responsible before the law for the contents declared. When... social housing is resolved, I commit to fully comply with the State's regulations on management and use of social housing".
Based on the above regulations, current housing laws only regulate the priority order and how to determine the list of priority groups and how to arrange apartments for priority groups in order of priority lists. In which, women are the number 5 priority order in the list of 5 priority groups.
The law on housing does not stipulate the distinction between single and married women who apply for social housing, but only stipulates that single or married people must meet the housing and income requirements as prescribed in Articles 29 and 30 of Decree No. 100/2024/ND-CP.
