A case reflecting problems related to changing the land use purpose of a part of the land area while the land plot has been granted a certificate. Accordingly, land users have a need to convert an additional part of garden land to residential land but are concerned about whether to carry out land separation procedures or not.
Regarding this content, the Ministry of Agriculture and Environment said that current legal regulations have specific guidance on cases of changing the land use purpose of a part of a land plot.
Accordingly, in Clause 3, Article 11 of Resolution No. 254/2025/QH15, in case land users change the land use purpose of a part of the land plot, it is not mandatory to separate the plot.
This regulation aims to remove practical obstacles and create convenience for people when carrying out procedures related to land use purpose conversion.

The Ministry of Agriculture and Environment said that the change of land use purpose must still be implemented according to the provisions of the Land Law, including considering planning, land use conditions and related financial obligations.
At the same time, even though plot separation is not mandatory, land users still need to fully implement the procedures according to regulations and be considered and decided by competent authorities.
To specifically resolve each case, the Ministry of Agriculture and Environment requests people to carefully study legal regulations, and at the same time contact local land management agencies to check dossiers and guide them to implement regulations correctly.
The correct implementation of the process will help ensure the legitimate rights of land users and avoid obstacles in the processing of dossiers.
