Red book with incorrect information needs to be corrected
According to the provisions of Clause 1, Article 152 of the Land Law No. 31/2024/QH15, if the red book contains incorrect information related to the land plot and assets attached to the land compared to the land registration declaration and assets attached to the land that have been verified and confirmed by the land registration authority or shown in the effective document of the competent authority on land dispute settlement, it must be corrected.
Or if there is incorrect information about the person granted the red book, it is necessary to correct and supplement the information.
Procedures for correcting red book information when incorrect
Step 1: Prepare documents to correct the red book
Application for red book correction includes:
- Original certificate; documents proving the information of the person granted the red book is incorrect compared to the information at the time of request for correction or incorrect information about the land plot and assets on the land compared to the information recorded in the issued red book.
- Power of attorney (if the land user or owner of property attached to the land carries out procedures through a representative according to legal regulations).
Step 2: Submit application for red book correction
Place to submit application at one-stop department at provincial, district, commune level or office/branch of land registration office.
Or submit application at land registration office.
Step 3: Correct information
Incorrect content will be corrected, according to Clause 28, Article 13, Circular 10/2024/TT-BTNMT.
Specifically: "(write the erroneous content) has an error, corrected to ... (write the corrected content) according to file number ... (write the registration procedure file code)".
Step 4: Return results.
Time to change land user information, change name on red book is no more than 5 days from the date of valid application.
Latest red book correction fee
According to Article 3 of Circular 85/2019/TT-BTC, the People's Council (PC) of the province where the land is located will decide the fee for correcting the red book. This fee is based on the certificate issuance fee in each locality, and the time of issuance of the book.
