Ms. T.T.T.H in Hanoi reflected that her family was granted a red book on February 11, 2004. In the red book, there is a T-shape on the cover 1 and page 2, the land use purpose is recorded as house.
Ms. H asked, is it possible for you to renew your red book to be consistent with the land list according to Article 9 of the 2024 Land Law, or is your house's red book subject to revocation?
Regarding this issue, the Ministry of Agriculture and Environment has the following opinions:
According to the above reflection, the issuance of certificates at the time of 2003 and 2004, the expression of land use purposes and convention symbols in cadastral books and land use right certificates is carried out according to the provisions of Circular No. 1990/2001/TT-TCDC dated November 30, 2001 of the Director General of the General Department of Land Administration guiding land registration, preparation of cadastral records and issuance of land use right certificates, accordingly, the land use purpose for residential land is symbolized by the letter T.
Therefore, it is proposed that you contact the commune-level People's Committee where the land is located to review the dossier for issuing certificates in the area, in case there are errors in information about the land plot (land use purpose), correct the certificate according to point b, clause 1, Article 152 of the 2024 Land Law.
The order and procedures for correcting the Certificate issued are in Point XIV, Content C, Part V, Appendix I, issued together with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government stipulating the division of authority of local authorities at 2 levels, decentralization, and decentralization in the field of land.
In case it is determined that the certificate has been issued for the wrong land use purpose as prescribed at the time of issuance of the certificate, it falls under the case of revocation of the issued certificate as prescribed in point d, clause 2, Article 152 of the 2024 Land Law.
The order and procedures for revocation and cancellation of issued certificates and issuance of certificates of land use rights and ownership of assets attached to land after revocation of issued certificates are implemented according to the provisions of Point XV, Content C, Part V, Appendix I issued together with Decree No. 151/2025/ND-CP.
