The early retirement regime for education officials after mergers and arrangements is a question that many people are interested in.

The Ministry of Education and Training requests that, in December 2025, all provinces and cities must complete the review and development of plans to arrange public educational institutions according to the 2-level government and report the results to the Central Government.

According to statistics from the Ministry of Education and Training at the end of December, public non-business units under the Ministry of Education and Training after being rearranged and streamlined to 65 units; the number of people working and receiving salaries from the state budget is 21,096 people, down 12.3% compared to 2021, equivalent to about 3,000 people.

Among the number of people working earning salaries from the state budget, there are many cases of early retirement after mergers and rearrangements of educational institutions. The issue that people are concerned about is the early retirement regime, how current regulations are implemented, including a question from Mr. Nguyen Van Hai - an official, working at the Department of Training and Quality Assurance at a community college.

On Hai said that in August-August 2025, he was eligible and applied for early retirement according to Decree No. 178/2024/ND-CP and No. 67/2025/ND-CP.

However, the Department of Home Affairs said that because the organizational structure of Mr. Hai's unit did not change, there was not enough basis to determine that it was the unit that carried out the organizational arrangement, so it did not resolve the regime for him.

Currently, the Central Steering Committee is implementing the arrangement of public service units and his school according to the plan to merge with another college.

Mr. Hai asked, is it true that before that he was not granted early retirement? Now that his school is merged with another college, is there a basis to determine that the unit has reorganized the organizational structure and is he entitled to early retirement according to Decree No. 178/2024/ND-CP and No. 67/2025/ND-CP? If not, according to what regime is he entitled to early retirement?

Regarding this issue, the Ministry of Home Affairs guides and implements Conclusion No. 183-KL/TW1 and Official Dispatch No. 322-CV/DU dated August 3, 2025 of the Party Committee of the Government on the implementation of Conclusion No. 183-KL/TW, the Ministry of Home Affairs has Official Dispatch No. 6383/BNV-TCBC dated August 13, 2025 sent to ministries, departments, branches, and localities on the implementation of Conclusion No. 183-KL/TW, in which it requests ministries, departments, branches, and localities to complete the settlement of policies and regimes according to the provisions of Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP dated March 15, 2025) before August 31, 2025, the time to take leave to enjoy policies and regimes is no later than September 1, 2025, after this time will end.

In the case of Mr. Nguyen Van Hai being a public employee of a community college, based on the provisions of Clause 4, Article 47 of the Law on Public Employees in 2010 (amended and supplemented in 2019), it is requested that he provide complete personal information to ask, and send it to the Provincial People's Committee (Department of Home Affairs) for consideration and settlement according to regulations.
