The Ministry of Agriculture and Environment has just sent an Official Dispatch to the People's Councils and People's Committees of provinces and centrally-run cities on the implementation of Decree No. 49/2026/ND-CP of the Government.
On December 11, 2025, the National Assembly issued Resolution No. 254/2025/QH15 stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law. On December 19, 2025, the Ministry of Agriculture and Environment issued Document No. 10596/BNNMT-QLDD to localities to promptly organize and implement the above Resolution.
On January 31, 2026, the Government issued Decree No. 49/2026/ND-CP detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law (effective from January 31, 2026).
To ensure the necessary conditions for the organization of the implementation of Resolution No. 254/2025/QH15 and Decree No. 49/2026/ND-CP, based on the provisions of law on promulgation of legal normative documents, the Ministry of Agriculture and Environment requests the People's Councils and People's Committees of provinces and cities to urgently implement the following tasks:
Allocate resources to organize implementation in provinces and cities.
Focus on organizing the implementation of Resolution No. 254/2025/QH15 and Decree No. 49/2026/ND-CP, in which: It is proposed to soon promulgate regulations on procedures and administrative procedures on land to ensure the principles, requirements, conditions, and clearly stipulate the responsibilities of agencies and competent persons, implementation time, dossier components, and subjects applying procedures.
The Ministry of Agriculture and Environment sends administrative procedures on land that have been reviewed and completed in the process of drafting Decree No. 49/2026/ND-CP for reference in the process of organizing the implementation of the Decree.
Regarding the order and administrative procedures related to the financial obligations of land users, in addition to the provisions of Decree No. 49/2026/ND-CP, it is necessary to base on Decree No. 50/2026/ND-CP dated January 31, 2026 of the Government detailing a number of articles of Resolution No. 254/2025/QH15 stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the 2024 Land Law on land use fees and land rent.
Promptly report to the Ministry of Agriculture and Environment on difficulties and obstacles in the process of organizing implementation (if any).
