The Ministry of Agriculture and Environment has just announced 2 new land procedures at the commune level and amended and supplemented 28 administrative procedures in this field. According to Decision No. 3380/QD-BNNMT announcing newly issued and amended and supplemented administrative procedures in the field of land under the state management scope of the Ministry, newly issued administrative procedures at the commune level include: Economic organizations receiving transfer, lease of land use rights, capital contribution in the form of land use rights to implement investment projects; Land allocation, land lease, sea area allocation to carry out sea encroachment activities.
The Ministry has also amended and supplemented 28 administrative procedures, including 20 provincial-level procedures and 8 commune-level procedures. Some procedures implemented at the commune level have been amended and supplemented, including: Changing the form of land allocation and lease; Registry of land and assets attached to land, issuance of Certificates of land use rights and ownership of assets attached to land for the first time for organizations currently using land; Registry of land and assets attached to land, issuance of Certificates of land use rights and ownership of assets attached to land for the first time for individuals, communities, households, people of Vietnamese origin residing abroad; Using land for multiple purposes, extending the land use plan for multiple purposes.
In addition, the commune level also carries out procedures for land allocation, land lease, and land use purpose conversion in cases of land allocation, land lease without auctioning land use rights, and not bidding to select investors to implement projects using land; cases of land allocation, land lease through bidding to select investors to implement projects using land; land allocation and forest allocation; land lease and forest lease, and extension of land use when the land use term expires.
Procedures for adjusting land allocation and lease decisions, allowing change of land use purpose due to changes in the basis of land allocation and lease decisions, allowing change of land use purpose; adjusting the land use term of investment projects are also carried out at the commune level. And the procedures for allocating residential land with land use fees are not through auctions or bidding to select investors to implement projects using land in some special cases as prescribed.
This Decision takes effect from August 25, 2025.
