Citizens should send questions to the Ministry of Agriculture and Environment asking about the following cases:
Citizens with a plot of agricultural land in Hanoi city, with an area of 3,200m2, have been granted a Certificate of Land Use Rights with the purpose of use being agricultural land, with a term of use until 2061.
According to the current construction planning and land use planning, this land plot belongs to the function of using commercial and service land, and is also in accordance with the land use planning approved by competent authorities.
Currently, after the local government implements the two-level urban government model, the conversion of land use purposes from agricultural land to commercial and service land is determined to be under the authority of the People's Committee at the commune level.
Therefore, citizens respectfully request the Ministry of Agriculture and Environment to provide specific instructions on the documents, order, and administrative procedures to be carried out when converting the above land use purpose, as well as the corresponding administrative procedure code in the current administrative procedure set.
Responding to this content, the Ministry of Agriculture and Environment said: Due to the lack of specific documents, the Ministry provided the following information:
Section I of Appendix III issued with Decree No. 151/2025/ND-CP stipulates the procedures for land allocation, land lease, and land use purpose conversion in the following cases:
Land allocation, land lease without auctioning land use rights, not bidding to select investors to implement projects using land;
Land allocation and land lease through bidding to select investors to implement projects using land;
Land allocation and forest allocation; land lease and forest lease.
In Decision No. 3380/QD-BNNMT dated August 25, 2025 of the Minister of Agriculture and Environment on announcing new administrative procedures issued, amending and supplementing land areas under the state management functions of the Ministry, in Decision No. 1,013949 stipulates the order and procedures for land allocation, land lease, land use purpose conversion, as well as land use extension when expired.
For specific instructions according to authority, citizens are requested to contact the People's Committee of the commune where the land is located for guidance and resolution in accordance with the provisions of law.
