According to the provisions of the Notary Law 2024, the procedure for notarizing a contract authorizing another person to make the latest red book in 2025 is as follows:
(1) Documents to prepare:
When notarizing the authorization document, the requirements for the issuer are to prepare the following documents:
- Notarization request form (according to the form provided by the notary organization): In this form, the person requesting the notarization needs to clearly state personal information such as full name, address, identification documents, notarization request content and list the documents attached to the authorization document.
- Identification documents to verify the identities of the parties involved, including:
+ valid ID card (CMND), Citizen identification card (CCCD) or passport.
+ ho chieu book or documents confirming residence (if necessary).
+ Marriage registration certificate or certificate of marital status (in case the marital relationship needs to be clarified to serve the authorization content).
(2) Notary agency for authorization documents
Pursuant to Article 19 of the 2024 Notary Law, the notary agency is a notary practice organization, including:
- Notary room.
- Notary office.
(3) Notarized period
Pursuant to Article 45 of the 2024 Notary Law:
Accordingly, the notary period is calculated from the date the notary receives the valid notary application recorded in the notary application book to the date of return of notarized results. The time for verifying, appraising the content related to the transaction, and listing the receipt of notarization of the inheritance division document is not included in the notarization period.
The notary period shall not exceed 2 working days; for transactions with complicated content, the notary period may be longer but not more than 10 working days. In case of force majeure events or objective obstacles or due to the cause of the notary requiring notarization leading to not being able to ensure the time limit as prescribed in this clause, the notary requiring notarization has the right to negotiate in writing with the notary practice organization on the notarization period.
(4) Notary fee
Notary fee includes: notary fee + fee, service fee according to requirements related to notarization.
Pursuant to the provisions of Article 4 of Circular 257/2016/TT-BTC, amended and supplemented by Article 1 of Circular 111/2017/TT-BTC, accordingly, the notary fee for authorization contracts is VND 50,000.
Fees and service prices according to requirements related to notarization are fees required for notary organizations to draft transactions, make machine drawings, photocopy, translate documents and papers related to transactions.
Pursuant to Article 71 of the 2024 Notary Law, notary professional organizations determine service prices for each type of work not exceeding the maximum price issued by the Provincial People's Committee and publicly post service prices at their headquarters.
