The new administrative procedure is to adjust the land use term on the land use right certificate, land use right certificate, ownership of houses and other assets attached to the granted land in Da Nang city.
This procedure is stipulated in the Government's Decree No. 76/2025/ND-CP of April 1, 2025, detailing the National Assembly's Resolution No. 170/22024/QH15 of November 30, 2024 on specific mechanisms and policies to remove difficulties and problems for projects and land in the conclusions of inspection, examination and judgments in Ho Chi Minh City, Da Nang City, Da Nang City and Khanh Hoa Province and Khanh Hoa Province.
Accordingly, within 5 working days from the date of the decision to publish a list of land use right certificates, land use right certificates, ownership of houses and other land -attached assets (certificates) issued by the Department of Agriculture and Environment of Da Nang City, the Land Registration Office is responsible:
Perform update to cadastral records, land databases for monitoring and management.
Notice in writing to land users, owners of properties attached to the land to adjust the land use term stated on the issued Certificate; The sending notice is made through public postal services, in case there is no recipient, make a list for monitoring and management.
Notice on the mass media on the list of issued numbers (Series of the Certificate), the number in the certificate of certification of the issued certificates. The notice is made 3 times, each time 30 days apart;
The written notice is enclosed with the issuing list (the serial number of the Certificate), the number of certificates of certificates to the Certificate to the Department of Justice, the notary practice organizations in the locality, the People's Committee of the district and the commune where the land, agencies, organizations, related parties (if any) for the procedure related to the issued certificate.
After receiving the notice, the adjustment of the land use term stated on the certificate granted as follows: The land user, the owner of the property attached to the land, the handling the security property submit a dossier to the Land Registration Office, the Branch of the Land Registration Office.
In case the land user or owner of the property is attached to the land with a new need to issue a new land use right certificate, ownership of property attached to the land, the land use term when implementing a new issuance of land use right certificates and ownership of properties attached to land is determined to be 50 years as prescribed in Article 3 of Resolution No. 170/2024/QH15.
