Citizens send questions to the Ministry of Agriculture and Environment with the content:
My household is stably using a plot of land for perennial crops from before August 1, 2024. This plot of land has not been granted a Certificate of land use rights, ownership of assets attached to land. In the process of land use, there were no disputes, complaints, lawsuits and my household has fully fulfilled financial obligations related to land.
Currently, due to no longer having the need to use it, my household wishes to voluntarily return the above-mentioned land plot for the commune-level People's Committee to manage and use.
Does my household have to carry out procedures for issuing a Certificate of Land Use Rights before submitting the dossier to return the land?
How are the order, procedures and components of the dossier for returning land in the above case regulated?
The Ministry of Agriculture and Environment answers:
According to the provisions of Article 82 of the 2024 Land Law and Articles 33, 35 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government; Section II, Part II, Appendix I of Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government, land users who no longer need to use land have a voluntary land return application; within 30 days from the date of receiving the document (citizen's voluntary land return application), the land management agency submits it to the competent state agency for land recovery.
The Ministry of Agriculture and Environment guides citizens to base on the above legal regulations to voluntarily return land when they no longer need to use land.
