Citizens should send questions to the Ministry of Agriculture and Environment asking about the following cases:
Citizens with a plot of land that has not been granted a Land Use Rights Certificate. The citizen has requested the People's Committee of the ward where he/she resides to provide information about the land inventory book of this land plot. However, the Ward People's Committee only provided the inventory book and map in 2014; for previous periods, the Ward People's Committee replied that there were no more archives - not handed over, and currently there are only maps from 2004 but no inventory books.
Is the ward People's Committee's response in accordance with the law? Is the fact that the Ward People's Committee does not have the above archival records considered a violation of regulations on management and storage of cadastral records?
Responding to this content, the Ministry of Agriculture and Environment said that according to the provisions of Clause 3, Article 60 of Decree 101/2024/ND-CP dated July 29, 2024 of the Government, the agency providing information and land data receives, processes and notifies fees, product and service prices to provide land information to organizations and individuals. In case of refusal to provide information and data, the reasons must be clearly stated and the requested organization or individual must be informed and respond to the request for information and land data within 2 working days from the date of receipt of the request.
According to the provisions of Clause 6, Article 60 of Decree 101/2024/ND-CP dated July 29, 2024 of the Government, the agency providing information and land data in the locality is the Land Registration Office. For localities that have not yet built a land database, the Land Registration Office and the People's Committees at the commune level are responsible for providing information and land data from cadastral records according to the cadastral records management hereunder.
Accordingly, in the above case, citizens can further contact the local Land Registration Office to request the provision of land information as requested.
