Reporting at the leadership meeting of Chuyen My Commune People's Committee, the Economic Department of Chuyen My Commune People's Committee reported on the implementation of the "45 days and nights to clean up land data" campaign and the "30 days" campaign to review and freely remove "T-shaped" data on the red book.
According to the Economic Department of Chuyen My commune, in the process of implementing the "45 days and nights cleaning up land data" campaign, up to now, the whole commune has reviewed 13,623 residential land plots, reaching 96.55%; for agricultural land, the review rate reached 81.8%.
For the "30 days" campaign to review and freely remove "T-shaped" data on land use right certificates for people, the whole commune has received 76 Certificates. Of which, 71 cases have been revised and returned to people.
Chairman of Chuyen My Commune People's Committee, Mr. Vu Van Huu, said that in the coming time, the locality will focus on implementing a number of key tasks. In which, continue to accelerate the progress of issuing Certificates of Land Use Rights to people; strengthen review, complete, and clean up land data.
In particular, Chuyen My commune will continue to review, revise, and freely remove "T-shaped" data on land use right certificates for people.
Regarding the deletion of "T" data on the red book, in an exchange with Lao Dong Newspaper, Lawyer Quach Thanh Luc (Hanoi Bar Association) said: A red book with the symbol T is a type of certificate issued according to land law regulations from 2023 and earlier and this case is quite common.
However, according to the current land designation system, residential land is denoted as ONT or ODT, depending on whether it is residential land in rural areas or residential land in urban areas.
Therefore, changing certificates to unify symbols will help people more conveniently in the process of making transactions on houses and land.
According to the lawyer, in the current process of changing certificates, there are cases where people's residential land area is reduced. When carrying out this procedure, people need to carefully study the legal regulations at the time the certificate is issued.
For example, certificates can be issued during the period of application of the 1987 Land Law, the 1993 Land Law, the 2003 Land Law or the 2013 Land Law. Depending on the time, the law has different ways of determining the limit and area of residential land.
Regarding the letter T symbol, according to the lawyer's understanding, in Decision No. 499/QD-DC in 1995 and No. 719/1999/QD-DC in 1999, the letter T symbol on the red book is used to represent residential land.
Therefore, if the certificate has the symbol T and this area has been identified as residential land at the time of issuance of the certificate, then when switching to the symbol ONT or ODT, the residential land area must be determined to be in the correct current status, the correct square meter and not reduced in area.
According to the lawyer, this is the content that people need to understand and grasp when carrying out administrative procedures related to land use right certificates.
