The People's Committee of Ho Chi Minh City has just issued Decision 95 regulating other documents related to land use rights before October 15, 1993 in Ho Chi Minh City.
The subjects of application are households and individuals who are using land stably according to the provisions of Point n, Clause 1, Article 137 of Land Law No. 31/2024/QH15.
According to the decision of the People's Committee of Ho Chi Minh City, land with 4 types of documents before October 15, 1993 will be granted red books, including:
The inventory book is established during the process of land registration according to Directive No. 299/TTG dated November 10, 1980 of the Prime Minister on land measurement, classification and registration nationwide, managed by state agencies, with the names of land users.
The housing authorization license, housing ownership authorization issued by the Department of Land and Public Works Management, the Department of Land or the People's Committee of the district, has the content of recognizing the right to own the house, the right to use residential land for the authorized person (the person designated or appointed to manage the property entrusted to a beneficiary according to the terms established by the donor).
Contract for purchase and sale of houses in installments executed by competent authorities (construction for sale), accompanied by Minutes of liquidation of house purchase and sale contract and Certificate of completion of payment for house purchase in installments.
Land use rights transfer documents, house sale and purchase documents are certified by the People's Committee of the commune level with the signature of the buyer, seller or the purchase and sale.
This Decision takes effect from October 30, 2024. Thu Duc City People's Committee and districts are responsible for reviewing and determining the correct scope and subjects of application according to the provisions of this Decision and related regulations.
During the implementation process, if there are any difficulties, problems, inappropriate content or new issues, the People's Committee of Thu Duc City and districts will report to the People's Committee of Ho Chi Minh City (through the Department of Natural Resources and Environment) for consideration and direction of implementation.
The 2024 Land Law stipulates 13 types of documents established before October 15, 1993 that households and individuals who are using land stably can use to carry out procedures for granting certificates of land use rights and ownership of assets attached to land (referred to as red books). Provincial People's Committees have the right to decide on other documents on land use rights.
