On May 7, Director of the Department of Natural Resources and Environment (DONRE) of Ho Chi Minh City Nguyen Toan Thang, Head of Working Group 5013, had a working session with businesses to remove obstacles to issue certificates (pink books) to home buyers of 2 projects in Nova's "ecosystem" with nearly 800 apartments.
These are the Ben Van Don 39-39B Apartment Complex project (commercial name The Tresor) invested by Nova Phuc Nguyen and the Hoang Minh Giam No. 8 Apartment Complex project (commercial name Garden Gate) invested by Nova Festival.
Reporting at the meeting, a representative of the Ho Chi Minh City Land Registration Office said that Garden Gate has a scale of 272 apartments, 116 officetel apartments on an area of 4,887 m2. In December 2016, the Ho Chi Minh City People's Committee issued Decision No. 6541 approving the land price plan according to the market for the project.
By January 6, 2017, Phu Nhuan District Tax Department had Confirmation No. 166 on the investor having paid land use fees and registration fees. The project has been issued Notice No. 68 by the State Appraisal Department of Construction Quality (Ministry of Construction) on the inspection of the project's completion and acceptance work, and the project has been handed over to the buyer for use...
Mr. Nguyen Toan Thang, Director of Ho Chi Minh City Department of Natural Resources and Environment, said that the reason for the Garden Gate project delayed in issuing the pink book is to ensure compliance with the regulations when implementing the project. Therefore, on December 13, 2018, Ho Chi Minh City People's Committee issued Official Letter 5596 approving the suspension of Decision No. 2218 on changing the land use purpose at 8 Hoang Minh Giam to assign the Department of Construction to assume the prime responsibility for, coordinate with the Department of Finance and related departments ... Reviewing the entire project processing process.
The inspection showed that the project fully implemented the contents according to regulations. Regarding the environmental license, Mr. Nguyen Toan Thang requested the investor to urgently complete it and commit to a completion time. After that, the Ho Chi Minh City Land Registration Office will issue pink books to 272 apartments. As for 116 officetel apartments, the Department of Land Economics (DONRE) will review financial obligations, then continue to issue pink books.
As for The Tresor Project, there are 476 apartments, 239 officetel apartments, and 7 commercial service apartments. This is one of three projects in Ho Chi Minh City that have been resolved according to Resolution 170 of the National Assembly on specific mechanisms to remove obstacles for projects and land in the conclusions of inspections, examinations, and judgments in Ho Chi Minh City, Da Nang and Khanh Hoa.
Then on April 1, 2025, the Government issued Decree No. 76 detailing Resolution No. 170. Up to now, the project has been completed and the State Appraisal Department of Construction Quality has issued Notice No. 160 on inspection of the work of accepting and completing the project in accordance with the license.
According to Mr. Phan Ngoc Bao An, General Director of Nova Phuc Nguyen, up to now, the investor has fully implemented the regulations related to the project and has handed over the apartment to customers for stable living and use.
"Therefore, in order to protect the legitimate rights of customers, we recommend that the Ho Chi Minh City Land Registration Office soon consider granting pink books to buyers," Mr. Phan Ngoc Bao An suggested.
Mr. Nguyen Toan Thang, said this is one of the projects that are concerned, expressed through Resolution 170 of the National Assembly as well as Decree 76 of the Government. "After today's working session, we will review and supplement the application so that when the judgment takes effect, it will immediately issue a pink book for the project," said the Director of the Department of Natural Resources and Environment of Ho Chi Minh City.
