Reporting on the situation of removing difficulties in resolving the issuance of land use right certificates and ownership of assets attached to land (pink books) in commercial housing projects in Ho Chi Minh City, Mr. Nguyen Toan Thang - Director of the Department of Natural Resources and Environment - said that after 4 months of establishing the working group, this unit has reviewed difficulties in 80 projects with 49,438 apartments, houses, plots of land, and officetel.
According to a report from the Ho Chi Minh City People's Committee, in recent years, the city has had more than 81,000 houses in 335 eligible projects but has not been able to complete the issuance of pink books, due to problems.
On November 5, 2024, the Ho Chi Minh City People's Committee issued Decision 5013 on the establishment of Working Group 5013 to focus on resolving issues related to the issuance of Land Use Rights Certificates and ownership of assets attached to land to organizations and individuals in commercial housing development projects in Ho Chi Minh City.
Working Group 5013 said that the standing agency, the Department of Natural Resources and Environment of Ho Chi Minh City, has organized 15 meetings of the Working Group to remove obstacles for 80 commercial housing development projects in Ho Chi Minh City.
Thereby, Working Group 5013 has removed obstacles to carry out procedures for granting Certificates to home buyers at 51/80 projects with the number of real estate products that have been removed being 38,363/49,438 apartments/houses/land plots/officetel; 655 parking lots; 1 property attached to the land; 15 floors for construction of commercial services.
Working Group 5013 has also identified 7 main groups of problems, including problems with legal regulations related to procedures for issuing pink books to home buyers in projects.
These are problems with the implementation of investors' obligations to regulate social housing in projects; problems with the implementation of additional financial obligations of investors in projects; problems with projects in the process of investigating, implementing inspection conclusions and implementing court judgments. In addition, there are problems with the failure to hand over technical infrastructure and social infrastructure at the project to local management; problems with reviewing project legality and problems with administrative violations of construction order.
Many issues have been handled according to the provisions of law, assigning the responsibilities of departments and branches for implementation.
Accordingly, for the group of problems related to determining additional financial obligations arising from investors self-dividing the commercial service floor into commercial and service blocks; the Department of Natural Resources and Environment of Ho Chi Minh City has organized the determination of land prices as a basis for submitting to the People's Committee of Ho Chi Minh City for approval of the land price plan to calculate arising financial obligations for each project.
In case the land price is later determined to not create additional financial obligations of the investor for the project, Working Group 5013 will assign the Department of Natural Resources and Environment of Ho Chi Minh City and the Ho Chi Minh City Land Registration Office to handle the procedures for granting pink books to individuals and organizations receiving the transfer of the commercial blocks after the above division in the project. Thus, projects in this group of problems will be resolved according to each case and incident.
To date, Ho Chi Minh City has completed removing legal obstacles and resolving the issuance of pink books for more than 70,675 apartments, reaching a rate of 87%. It is expected that this year, the city will complete the removal of difficulties and issue pink books to all projects in the area.
