Ho Chi Minh City People's Committee has just issued a decision to recover the land plot at lot E2a-8, N10 street, Ho Chi Minh City High-Tech Park, which was leased by the Management Board of the High-Tech Park to USM Biomedical Technology Research Center under Land Lease Contract No. 104/HDTD/KCNC-2016 signed on April 6, 2016. In 2019, this unit changed its name to Meikotec Biomedical Technology Center.
According to the decision, the reason for the recovery is that the land area was allocated and leased to the wrong subjects as prescribed in Clause 3, Article 81 of the 2024 Land Law.
The Ho Chi Minh City People's Committee assigned the Management Board of the High-Tech Park to organize the handover of the land recovery decision to Meikotec Biomedical Technology Center and related organizations and individuals according to regulations. In case the unit does not receive the decision or is absent, the Management Board must make a record and publicly list it.
At the same time, the Management Board of the Hi-Tech Park is responsible for coordinating with Meikotec Biomedical Technology Center and related units to receive and manage the recovered land area; prevent encroachment, illegal construction and propose handling plans according to regulations.
On the side of Meikotec Biomedical Technology Center, the Ho Chi Minh City People's Committee requested the unit to complete related financial obligations such as land rent, infrastructure usage costs, public utilities, security and order fees in the High-Tech Park (if any), and at the same time coordinate to hand over the land.
The Department of Finance is assigned to guide the handling of the remaining land rent for the period of non-use according to regulations. The Ho Chi Minh City Tax Department is responsible for inspecting and recovering land rent if any remaining obligations arise.
In addition to the above case, the Ho Chi Minh City People's Committee also decided to recover land plot T2-1.4, 6,600m2 wide on D1 street, High-Tech Park, Tang Nhon Phu ward. This land area was previously leased by the High-Tech Park Management Board to High-Tech Investment Development and Service Joint Stock Company under Contract No. 100/HDTD/KCNC-2016 signed on March 1, 2016.
The reason for the recovery is that the investment project has ceased operations according to the provisions of the law on investment, and falls under the case of land recovery according to point d, clause 1, Article 82 of the 2024 Land Law.
In addition, the Ho Chi Minh City People's Committee also issued a decision to recover a land area of 140.2m2 at No. 362 - 364 Vo Van Tan (Ban Co ward) leased by Construction and Real Estate Business Joint Stock Company III according to Decision No. 2733/QD-UBND dated June 23, 2010.
According to the Ho Chi Minh City People's Committee, this land area belongs to the case where the State leases land for a definite term but does not extend the land use term according to Official Dispatch No. 4824/UBND-ĐT dated December 14, 2022 of the City People's Committee. The recovery is carried out according to point c, clause 1, Article 82 of the 2024 Land Law.
