Ho Chi Minh City rewards up to 200 million VND if land is handed over early

The People's Committee of Ho Chi Minh City has just issued Decision 68/2024/QD-UBND dated September 25, 2024 regulating compensation and resettlement support when land is acquired in Ho Chi Minh City.

Pursuant to Clause 7, Article 111 of the 2024 Land Law, people whose residential land is recovered to implement urban construction investment projects will be compensated with residential land and on-site housing; while waiting for resettlement arrangement, they will be assigned to temporary housing or supported with housing rental; the specific time and level of support will be determined by the Provincial People's Committee in accordance with local realities.

In case of land acquisition for other purposes, compensation shall be made in the form of land and housing on the spot if there is a land fund and resettlement housing fund in the land acquisition area. Priority shall be given to locations convenient for households and individuals using residential land in combination with business services, and those whose land is acquired are those who have contributed to the revolution. There shall be a reward mechanism for those whose land is acquired and who hand over the site before the deadline as prescribed by the Provincial People's Committee.

The Ho Chi Minh City People's Committee has just issued Decision 68/2024/QD-UBND dated September 25, 2024 regulating compensation and resettlement support when land is recovered in Ho Chi Minh City. In particular, the regulations on rewards for people whose land is recovered and who hand over the site before the prescribed deadline are as follows:

1. In case of total recall:

(i) Units and organizations performing the tasks of compensation, support and resettlement are responsible for determining the reward level for organizations (excluding State agencies and administrative units) as follows: Rewarded 10,000 VND/m2 of land with factory and office buildings recovered, but not exceeding 200,000,000 (Two hundred million VND)/organization and not less than 15,000,000 (Fifteen million VND)/organization.

(ii) For households and individuals whose houses and land are recovered: VND 15,000,000/time.

(iii) For households and individuals whose agricultural land is recovered: calculated at 50% according to the provisions at Point b of this Article.

2. In case of partial withdrawal:

- For organizations: calculated at 50% according to the provisions in (i).

- For households and individuals whose houses and land are recovered: calculated at 50% according to the provisions in (ii).

- In case a household or individual has part of their agricultural land recovered: calculated at 50% according to the provisions in (iii).

3. In case an organization, household or individual has multiple types of land recovered at one location in the same project, they will receive additional support at the highest level among the levels specified in 1 and 2; in case there are multiple houses and lands cleared at different locations, each compensation file will be resolved.

Thus, with the above regulation, organizations with recovered land in Ho Chi Minh City that hand over the site before the prescribed deadline will be rewarded up to 200 million VND.
