Pursuant to the provisions of Article 39 of Decree 95/2024/ND-CP on the responsibility of the People's Committee in reviewing and approving the application for registration to buy social housing for resettlement as follows:
Article 39. Arrange social housing to serve resettlement
1. The person to be resettled who needs to buy, rent, or lease-purchase social housing must submit an application for registration to buy, rent, or lease-purchase social housing to the People's Committee of the district where he/she resides according to the application form for registration to buy, rent, or lease-purchase social housing according to the provisions of law on the development and management of social housing.
2. Within a maximum of 15 days from the date of receipt of the registration, the People's Committee at the district level is responsible for checking and confirming that the subject has not been compensated by the State with housing and residential land in the registration and compiling a list to send to the provincial housing management agency for review and inspection.
3. Within a maximum of 15 days from the date of receipt of the list of the District People's Committee, the provincial housing management agency shall inspect and make a list of individuals and households eligible to buy, rent, or lease-purchase social housing and shall have a document requesting the Provincial People's Committee to approve the list.
4. After the Provincial People's Committee approves the list, within a maximum of 15 days, the provincial housing management agency must notify the person on the resettlement list to sign a contract, and at the same time send a document to the investor of the social housing construction project to sign a house purchase, lease or hire-purchase contract with the person being resettled when the house is eligible for sale, lease or hire-purchase according to regulations.
Households and individuals named in the list specified in this clause are given priority for arranging the purchase, rental or lease of social housing without having to carry out procedures for approval of subjects according to the provisions of the law on the development and management of social housing. In case the person who needs to buy, rent, or lease-purchase social housing exceeds the number of houses arranged for resettlement in the social housing project, these subjects must draw lots before signing a house sale, lease-purchase or lease-purchase contract.
5. Within a maximum period of 15 days from the date the social housing is eligible for sale, lease, or lease-purchase, the investor is responsible for signing a contract to buy, rent, or lease-purchase social housing according to the form issued by the Ministry of Construction with households and individuals on the list approved by the Provincial People's Committee or who have won a draw if they are subject to a draw.
The handover and management and use of the house after receiving the handover are carried out according to the contract and regulations in Article 40 of this Decree.
At the same time, according to the provisions of Clause 1, Article 14 of Decree 140/2025/ND-CP as follows:
Article 14. Duties and authority related to social housing
1. Responsibility for receiving applications for registration to buy, rent or lease-purchase social housing from people being resettled; checking and confirming the subjects; making a list of households, individuals and households eligible to buy, rent or lease-purchase social housing as prescribed in Clause 1, Clause 2 and Clause 3, Article 39 of Decree No. 95/2024/ND-CP dated July 24, 2024 of the Government, implemented by the People's Committee at the commune level.
Accordingly, during the process of approving the application for social housing purchase for resettlement, the People's Committee has the following responsibilities:
- The People's Committee at the commune level is responsible for checking and confirming that the subject has not been compensated by the State with housing and residential land in the registration application and compiling a list to send to the provincial housing management agency for review and inspection.
- The provincial People's Committee is responsible for approving the list of subjects that have not been compensated by the State with housing and residential land.
