Order and procedures for selling, leasing, buying, and leasing social housing according to new regulations

The Government issued Decree No. 54/2026/ND-CP (effective February 9, 2026), which is noteworthy for regulations on social housing.

Decree No. 54/2026/ND-CP amends and supplements Article 38 of Decree No. 100/2024/ND-CP on the order and procedures for selling, leasing, buying, and leasing social housing invested in construction according to projects and not using public investment capital, trade union financial sources in the direction of expanding and standardizing the form of information disclosure on information systems, databases on housing and the real estate market, diversifying the way of submitting dossiers (directly, online, via post or through agencies and units where employees work). At the same time, clearly stipulate the dossier processing time; priority subject order, and how to handle when the number of priority subjects exceeds the target. Specifically:

1. Order and procedures for selling social housing are implemented as follows:

a) After 30 days from the start of the project, the investor of the social housing construction investment project is responsible for providing information related to the project for public announcement on the electronic information page of the Department of Construction, the People's Committee of the commune level in the locality where the project is located; posting at least once in the newspaper as the mouthpiece of the local government and announcing on the electronic information page of the investor (if any) or the Real Estate Exchange of the investor (if any) for people to know, prepare dossiers to register to buy social housing and carry out monitoring and supervision.

Public information includes: Project name; project investor; project construction location; contact address, registration address; project implementation progress; project scale; number of apartments/houses (including: Number of apartments/houses for sale; apartment area; selling price (temporary) for each type of apartment/house; expected start time for receiving registration documents and other related content).

In case the information system and database on housing and the real estate market have been connected and exploited, publicize information about social housing construction investment projects on this system in accordance with the law on construction and management of information systems and databases on housing and the real estate market;

b) Before the time of starting to receive applications for social housing purchase, the investor publicly discloses information about the time of starting to receive and ending to receive applications for purchase, the number of apartments/houses for sale, apartment area, selling price of social housing on the information system, database on housing and real estate market and sends it to the local Department of Construction where the project is located for public disclosure on the electronic information page of the Department of Construction.

Information disclosure must be carried out at least 30 days before the time of starting to receive dossiers;

c) Based on information about social housing projects that has been publicized, households and individuals who need to submit applications to buy social housing to the project investor. Each household and individual who needs to buy social housing is not allowed to simultaneously register to buy social housing in multiple projects at the same time.

Subjects specified in Clause 10, Article 76 of the Housing Law must have confirmation of the subject from the People's Committee of the commune where the land is recovered and must clear and demolish houses according to the guidance form of the Minister of Construction. Within 7 days from the date of receiving the request for confirmation, the People's Committee of the commune shall carry out the confirmation of the subject.

The submission of dossiers is carried out in the form of direct, online or postal services or submitted to agencies, units, and businesses where the individual is working to summarize and send to the project investor.

The time to submit and receive dossiers is decided by the investor but is at least 30 days from the date of starting to receive dossiers;

d) Application documents for social housing purchase include: application form for social housing purchase according to Form No. 01 specified in Appendix II of this Decree; documents proving the subjects and conditions eligible for social housing support policies.

Documents proving the subjects and conditions eligible for social housing support policies are valid for 12 months, calculated from the time of confirmation. People registering to buy social housing must commit not to have received housing support policies and be responsible for ensuring the subjects and conditions eligible for social housing support policies at the time of signing the purchase and sale contract;

e) Within 10 days from the date of expiry of the application, the investor is responsible for summarizing the List of social housing purchase registrations, which shows the personal information of the registrant and members of the household declared in the Social Housing Purchase Registration Application; send it to the Department of Construction of the locality where the project is located to check whether the social housing purchase registrant has enjoyed or has not enjoyed housing support policies according to the provisions of housing law. The Department of Construction is responsible for responding in writing within 10 days from the date of receiving the Registration List.

The investor is responsible for reviewing, evaluating, summarizing the opinions of the Department of Construction and comparing them with the provisions of the law on housing to determine dossiers that meet the conditions to enjoy social housing support policies.

The investor is responsible for compiling and publicizing the List of dossiers that meet the conditions according to regulations and dossiers that do not meet the conditions at the project implementation location, the investor's electronic information page (if any) and at the investor's Real Estate Exchange (if any).

Within 30 days from the deadline for submitting dossiers, the investor is responsible for publicizing the List of dossiers that meet the conditions for purchasing social housing. For dossiers that do not meet the conditions, send them back and state the reasons within 15 days from the date of publicizing the List;

e) In case the total number of eligible registration dossiers in the list at point d of this clause is equal to or less than the total number of apartments/houses expected to be sold, the purchase and sale shall be carried out according to the agreement between the investor and the customer;

g) In case the total number of eligible applications in the list at point d of this clause is greater than the total number of apartments/houses expected to be sold, the investor organizes a draw to select people to buy social housing.

The form of lottery is decided by the investor but must be supervised by representatives of the local Department of Construction, representatives of the Commune People's Committee, representatives of the Commune Police where the project is located, confirmed in the lottery result record;

h) In case the project has priority subjects as prescribed in point d, clause 1, Article 79 of the Housing Law, it is prioritized to buy social housing without having to draw lots with the number of apartments equal to the total number of eligible dossiers of these priority groups out of the total number of eligible dossiers in the list specified in this clause multiplied by the total number of apartments/social housing expected to be sold.

Prioritizing female subjects is applied to cases where the applicant is a single female or must be the head of household of the household based on the residence database.

Priority subjects specified in point d, clause 1, Article 79 of the Housing Law are arranged apartments/houses in the following order: people with meritorious services to the revolution, relatives of martyrs, people with disabilities, people arranged for resettlement in the form of buying social housing, women. In case the number of priority subjects in 1 group exceeds the number of remaining priority apartments/houses, a draw is conducted between that group of priority subjects, the remaining subjects are allowed to continue to participate in the draw along with the non-priority subjects;

i) After the house meets the conditions to be sold according to the provisions of the law on real estate business, the investor shall sign a social housing purchase and sale contract with the customer; and at the same time update information about transactions, subjects who have purchased social housing according to the provisions of the law on housing, law on construction and management of information systems, databases on housing and the real estate market.

The project investor is responsible for publicly announcing the List of customers who have signed social housing purchase and sale contracts (including family members) at the investor's office, at the project implementation location and at the Real Estate Exchange (if any) or the investor's social housing electronic information page (if any).

2. The order and procedures for leasing social housing for purchase are implemented according to the provisions of Clause 1 of this Article.

3. The order and procedures for social housing rental are carried out according to the provisions of Clause 1 of this Article and do not require submitting documents proving housing conditions and income. In case social housing rental belongs to public assets, the lessee submits documents proving that it is eligible for exemption or reduction of social housing rent (if any).
