Encroached land that meets the conditions prescribed by the 2024 Land Law can still be granted a red book.

Conditions for encroached land to be granted red book

- Case 1: Land use due to encroachment, occupation of construction safety corridors, encroachment of roadsides...

Conditions for granting red book:

+ There has been a planning adjustment but the encroached land area is no longer within the construction safety corridor.

+ Not within construction boundaries.

+ Not intended for use in agency headquarters, public and career facilities.

- Case 2: Using encroached land, occupying land of agricultural and forestry origin.

Conditions for granting red book:

+ Land under forestry planning for protective forests, special-use forests... without a forest management board, the person using encroached land will be allocated land by the State for the purpose of forest protection and development and considered for issuance of a red book.

- Case 3: People who are using land stably, in accordance with district-level planning/general planning/zoning planning/construction planning/rural planning will be considered for red book issuance.

- Case 4: Households and individuals using self-reclaimed agricultural land and having no disputes will be granted red books according to the agricultural land allocation limit; if exceeding the limit prescribed by the Provincial People's Committee, the excess area must be converted to State land lease.

Fees to be paid when issuing red book

+ Land use fee

- For the area granted a red book within the land recognition limit as prescribed in Clause 5, Article 141 of the 2024 Land Law, land use fee:

Land use fee = Land area granted red book within the recognized residential land limit x land price in the land price list x 10%.

- For areas exceeding the limit in the red book, land use fees are calculated as follows:

Land use fee = Land area exceeding the limit x land price in the land price list x 30%.

+ Registration fee: (Land price x area of ​​land certificate) x 0.5%.

+ File appraisal fee: Decided by the provincial People's Council, depending on the time.

+ Red book issuance fee: This amount ranges from 100,000 VND - 120,000 VND.
