Pursuant to the provisions of Point b, c, d, Clause 2, Article 89 of the 2023 Housing Law, the reselling of social housing is regulated as follows:
The lease-purchase of social housing is carried out in accordance with the provisions of Point a and Point b, Clause 1 of this Article and the following provisions:
- The lessee who buys social housing cannot resell the house for a period of 5 years from the date of full payment of the house purchase rent within the time limit prescribed in Point a of this Clause, except for the case specified in Point c of this Clause.
- Within 5 years, from the date the buyer has paid enough rent to buy houses but in need of selling this house, it is only sold to housing management agencies in case of renting social housing invested by public investment capital or resell to investors of social housing construction investment projects in the case of renting social housing for construction of non -public housing with minimum people who have been sold for public houses or sell for maximum people to buy and sell for public people equal to the price of this social housing in the sale contract with the housing management agency or the investor of the social housing construction investment project. The payment of personal income tax complies with the tax law.
- After a period of 5 years, from the date the lessee has paid the full rental fee for social housing within the time limit prescribed in Point a of this Clause, the lessee may resell this house according to the market mechanism prescribed in Point e, Clause 1 of this Article.
Accordingly, social housing tenants will be allowed to resell their houses after a period of 5 years, from the date they have paid the full rental fee for social housing within the prescribed period (at least 5 years, from the date of signing the lease-purchase contract) according to the market mechanism if they have been granted a Certificate.
Social housing buyers are not allowed to resell their houses within 5 years, from the date of payment of enough rent to buy houses according to the prescribed time limit. The tenant can still resell, but the transfer subject is limited, just a housing management agency for social housing invested by public investment or resell to investors if the social housing is not built with public investment capital or the subject of social housing purchases at the maximum selling price equal to this social housing price in this contract.
