The Ministry of Agriculture and Environment has issued Decision 3969/QD-BNNMT announcing newly issued internal administrative procedures; amending and supplementing the land sector under the state management scope of the Ministry.
The decision to amend and supplement the specific land valuation order for cases under the authority of the Chairman of the People's Committee at the commune level is as follows:
Step 1: The competent land management agency at the commune level is responsible for preparing specific land valuation records.
Step 2: The competent land management agency at the commune level decides to place an order, assign tasks to a public service unit qualified to conduct land price consulting activities or select a land price consulting organization according to the provisions of the law on bidding to determine specific land prices.
Step 3: The competent financial management agency shall submit to the Chairman of the People's Committee at the commune level a decision to establish a specific land price appraisal council.
Step 4: The financial institution submits to the Chairman of the specific land appraisal council a decision to establish a working group of the council.
Step 5: Organize land valuation:
a) Conduct specific land price determination and provide information on investigation results, collect input information to competent land management agencies;
b) Develop a land price plan, draft a land valuation certificate and send it to the competent land management agency.
Step 6: The competent authority for land management at the commune level:
a) Publicly report an explanation for the development of a land price plan on the Electronic Information Portal;
b) Check the full content of the explanatory report on the development of land price plans;
c) Submit to a specific land valuation council. The dossier submitted to the specific Land Valuation Council includes:
- Documents requesting appraisal of land price plans;
- Report on land price plan;
- Explanatory report on the development of land price plans, draft land valuation certificates;
- Specific land valuation records.
Step 7: The specific land price appraisal council appraises the land price plan and sends the document appraising the land price plan to the competent land management agency at the commune level.
Step 8: The competent land management agency at the commune level organizes the implementation of receipt, explanation, editing and completion of the land price plan.
Step 9: The competent land management agency at the commune level shall submit to the Chairman of the People's Committee at the commune level for decision on specific land prices. The dossier includes:
a) Report on the land price plan of the competent land management agency;
b) Explanatory report on the development of land price plans, land valuation certificates;
c) Documents on appraisal of land price plans of specific land price appraisal councils;
d) Minutes of the meeting of the specific land valuation council;
d) Report on receiving, adjusting and completing the land price plan according to the document appraising the land price plan of the specific land valuation council.
Step 10: In case a specific land price is applied to calculate compensation when the State reclaims land according to the provisions of Point e, Clause 1, Article 160 of the Land Law, the competent land management agency at the commune level shall provide a land price plan to the unit or organization performing the task of compensation, support, and resettlement to develop a compensation, support, and resettlement plan; the appraisal and approval of the land price plan shall be carried out in accordance with the provisions of Clause 3, Article 34 and Clause 3, Article 35 of Decree No. 71/2024/ND-CP.
Step 11: The competent land management agency shall store and update in the national land database and publicize the report explaining the land price plan and land price decision on the Electronic Information Portal. Specific land valuation records shall be kept for at least ten years from the date of the decision approving the specific land price by the competent state agency, unless otherwise provided by law.
Step 12: Within no more than 15 days from the date the Chairman of the People's Committee at the commune level decides on specific land prices, the competent land management agency shall send the results of determining specific land prices to the Ministry of Agriculture and Environment according to Form No. 43 of Appendix II issued with Decree No. 151/2025/ND-CP.
