Citizens should send questions to the Ministry of Agriculture and Environment, questioning the conversion of land use purposes from agricultural land to non-agricultural land due to the conversion needs of households and individuals (registry of changes).
According to Decree 151, the authority to issue a decision to change the purpose is the Chairman of the Commune People's Committee, but it does not clearly stipulate the authority to confirm the content stated on the Land Use Rights Certificate.
So which agency signs to confirm the content of the change of purpose on the Land Use Rights Certificate?
Responding to this content, the Ministry of Agriculture and Environment said that Clause 2, Article 136 of the 2024 Land Law stipulates:
"Article 136. Authority to issue Certificates of land use rights and ownership of assets attached to land
The authority to issue Certificates of land use rights, ownership of assets attached to land, and confirmation of changes in cases of registration of changes is regulated as follows:
a) Organize land registration for land users, owners of assets attached to land who are domestic organizations, affiliated religious organizations, foreign organizations with diplomatic functions, economic organizations with foreign investment capital; issue Certificates of land use rights and ownership of assets attached to land to owners of assets attached to land of foreign organizations and foreign individuals;
b) Branches of land registration organizations or land registration organizations that allow land users and owners of assets attached to land who are individuals, communities, or people of Vietnamese origin residing abroad;
c) Land registration organizations and branches of land registration organizations are allowed to use their seals to issue Certificates of land use rights and ownership of assets attached to land or confirm changes to the issued Certificate."
At point e, clause 1, Article 133 of the 2024 Land Law, it is stipulated that:
"Article 133. Registering changes
Registration of changes is carried out in cases where a Certificate of land use rights or a Certificate of house ownership rights and land use rights or a Certificate of house ownership rights or a Certificate of construction ownership rights or a Certificate of land use rights, house ownership rights and other assets attached to land or a Certificate of land use rights and ownership rights of assets attached to land has the following changes:
e) Change of land use purpose as prescribed in Clause 1, Article 121 of this Law; in the case specified in Clause 3, Article 121 of this Law, the land user needs to register changes."
Clause 2, Article 136 of the 2024 Land Law stipulates the authority to issue Certificates of land use rights and ownership of assets attached to land, confirm changes in cases of registration of changes, and request citizens to study the regulations for implementation.
