The Ministry of Agriculture and Environment received questions from citizens, requesting instructions on the process and specific regulations to handle applications for land improvement from individuals using agricultural land.
Regarding this issue, the Ministry of Agriculture and Environment said that the conversion of crop and livestock structure on rice-growing land is carried out in accordance with the provisions of Articles 6 and 8 of Decree No. 112/2024/ND-CP dated September 11, 2024 detailing regulations on rice-growing land:
Article 6. Regulations on converting crop and livestock structure on rice-growing land
1. Principles of crop and livestock restructuring on rice-growing land
a) Comply with the provisions of Clause 1, Article 56 of the 2018 Law on Crop Production;
b) Only implement the conversion of crop and livestock structure on rice-growing land to perennial crops for the remaining rice-growing land;
c) Not allowed to convert crop and livestock structure on rice-growing land in high-yield, high-quality rice-growing planning areas;
d) In accordance with the Plan for converting crop and livestock structure on rice-growing land issued by competent authorities;
d) Not causing pollution or degradation of rice-growing land; not damaging traffic works, irrigation works, dykes, works directly serving rice production;
e) Does not affect the cultivation of adjacent rice-growing land.
2. When converting from rice cultivation to rice cultivation combined with aquaculture, a maximum of 20% of the rice-growing land area can be used to lower the aquaculture ground to a depth of no more than 120cm from the field surface.
Article 8. Documents and procedures for implementing crop and livestock restructuring on rice-growing land
1. The user of rice-growing land who wants to convert to perennial crops, rice cultivation combined with aquaculture, shall submit a registration for converting the crop and livestock structure on rice-growing land (hereinafter referred to as the registration) to the People's Committee at the commune level according to the form of Appendix IV issued with this Decree.
2. Within 5 working days from the date of receipt of the valid Registration for conversion of crop and livestock structure on rice-growing land; The People's Committee at the commune level shall consider the suitability of the registration with the Plan for conversion of crop and livestock structure on rice-growing land at the commune level.
a) In case the registration is consistent with the plan for converting the structure of crops and livestock on annual rice-growing land of the commune level, the People's Committee at the commune level shall issue a document approving the conversion according to the form in Appendix V issued with this Decree, and send it to the registered rice-growing land user;
b) In case the registration is not in accordance with the Plan for converting the structure of crops and livestock on annual rice-growing land of the commune level, the People's Committee at the commune level shall notify in writing according to the form of Appendix VI issued with this Decree, the rice-growing land user shall register.
The Ministry of Agriculture and Environment recommends that citizens study to comply with regulations.
