The Ministry of Education and Training (MOET) posted a draft Decree detailing a number of articles of the Law on Vocational Education on the Ministry's website for comments.
According to the Government's submission of the Ministry of Education and Training on the draft Decree detailing a number of articles of the Law on Vocational Education, the purpose of issuing the Decree is to promptly institutionalize and guide new regulations of the Law on Vocational Education, create a synchronous and unified legal framework, aiming to create a favorable legal environment for the development of vocational education, meet the needs of learners, the labor market; requirements on qualifications and professional skills in the ASEAN region and international integration.
At the same time, the Decree overcomes the shortcomings and limitations of the law and the current law enforcement process on vocational education.
According to the Ministry of Education and Training, the Decree also promptly removes obstacles and difficulties, solving "bottlenecks" in practice to innovate and improve the quality of vocational education.
This Decree details a number of articles of the Law on Vocational Education on: Naming and renaming vocational training institutions; organization under different names of vocational secondary schools; Conditions, procedures, authority to establish, license operations, stop enrollment, suspend operations, dissolve branches; Standards, use, management, policies for co-organized lecturers...
Regarding the suspension of vocational education activities for branches of vocational training institutions, the draft Decree clearly states:
1. Branches of vocational training institutions are suspended from vocational training activities in the following cases:
a) Committing fraud to establish or permit the establishment of a branch of a vocational training institution or to be licensed for vocational education activities for a branch of a vocational training institution;
b) Not ensuring one of the conditions specified in Article 14 of this Decree;
c) Organizing vocational education activities without a license to operate vocational education;
d) Violating the provisions of the law on vocational education shall be subject to administrative sanctions to the extent of having to suspend operations;
d) Other cases as prescribed by law.
2. Procedures for suspending vocational education activities for branches of vocational training institutions:
a) The competent authority granting a license to operate vocational education for a branch of a vocational training institution specified in Article 16 of this Decree shall conduct an inspection to assess the level of violation of a vocational training institution;
b) Based on the level of violation, the competent authority specified in Article 16 of this Decree shall decide to suspend vocational education activities;
c) The decision to suspend vocational education activities of the branch must clearly identify the reasons for the suspension, the suspension period, and measures to ensure the legitimate interests of learners, teachers, managers, employees, and workers.
The decision to suspend is publicly announced in the mass media, the electronic information page of the vocational training institution with the branch of vocational education suspended and the electronic information page of the agency deciding to suspend;
d) After the suspension period, if the cause of the suspension is remedied, the competent person deciding to suspend or issue a decision allowing the continued organization of vocational education activities.
The draft Decree details a number of articles of the Law on Vocational Education until December 28.
