The Ministry of Education and Training issued Circular 71/2026/TT-BGDDT dated August 27, 2026, regulating the school council of private higher education institutions and private vocational education institutions.
This Circular stipulates the structure, standards for members of the school council, tasks, powers, terms, procedures for election, appointment, dismissal of chairmen and members of the private school council, operating and supervisory mechanisms of the university council for private universities, school councils for private universities (boards of private higher education institutions); structure, members' standards, tasks, powers, terms, election or election, dismissal of chairmen and members of the school council, operating and supervisory mechanisms of the school council, relationship between investors and the school council, principals of private vocational education institutions (boards of private vocational education institutions).
Article 4 of the Circular clearly states the structure and standards of members of the council of private universities.
1. The school council has a fractional number of members, no more than 15 people and has the composition as prescribed in Clause 3, Article 17 of the Law on Higher Education No. 125/2025/QH15.
2. Members of the school council must meet the following minimum standards:
a) Having moral qualities, prestige, capacity and experience suitable to the tasks of a member of the school council; complying with the Party's guidelines and policies, and the State's laws;
b) Having full civil act capacity; not falling into the case of being declared lost by the Court or declared with limited civil act capacity or having difficulty in perceiving and mastering the act;
c) Not being undergoing imprisonment or administrative handling measures to be sent to compulsory drug rehabilitation centers, compulsory education centers or being subject to compulsory medical treatment measures;
d) Meeting the conditions and standards corresponding to the composition of the school council they represent according to the provisions of law and the organizational and operational regulations of the educational institution.
3. The Chairman of the school council must ensure the standards of members as prescribed in Clause 2 of this Article, have the capacity to organize and manage the activities of the school council and not concurrently hold the position of principal of that private higher education institution.
4. Based on the provisions of this Circular, private higher education institutions are responsible for specifically stipulating in the regulations on organization and operation the number, proportion, structure and standards of members and chairmen of the school council after being approved by the investor; specific standards must not be lower than the standards specified in this Article.
