Pursuant to Article 7 of Decree 178/2024/ND-CP amended by Clause 5, Article 1 of Decree 67/2025/ND-CP, policies for people retiring early due to organizational restructuring are stipulated:
Subjects specified in Clause 1 and Clause 3, Article 2 of this Decree who retire early are entitled to the following benefits:
1. Receive a one-time pension for early retirement:
For those who retire within the first 12 months from the date of the decision to reorganize the apparatus by the competent authority:
In case of aging from 05 years or less to the retirement age specified in Appendix I and Appendix II issued with Decree No. 135/2020/ND-CP, they will receive a subsidy equal to 1 month of current salary multiplied by the number of months of early retirement compared to the time of retirement.
In case of retirement age of more than 5 years to 10 years as prescribed in Appendix I issued with Decree No. 135/2020/ND-CP, they will receive a subsidy equal to 0.9 months of current salary multiplied by 60 months.
For those who retire from the 13th month onwards from the date of the decision to reorganize the apparatus by the competent authority, they will receive a subsidy of 0.5 at Point a, Clause 1 of this Article.
Thus, in the first case, civil servants and public employees who retire early from the 13th month onwards from the date of the decision to reorganize the apparatus by the competent authority will only receive 50% of the one-time pension allowance.
At the same time, Chapter II of Decree 178/2024/ND-CP, supplemented by Clause 7, Article 1 of Decree 67/2025/ND-CP, stipulates policies for people retiring early due to staff streamlining, restructuring and improving the quality of the staff, civil servants and public employees:
Subjects specified in Clause 2, Article 2 of this Decree who retire early are entitled to the regimes specified in Clause 2, Article 7 of this Decree; are entitled to a one-time pension for early retirement:
1. For those who retire within 12 months from March 15, 2025, they will receive a subsidy equal to 1 month of current salary multiplied by the number of months of early retirement compared to the retirement date prescribed in Appendix I and Appendix II issued with Decree No. 135/2020/ND-CP;
2. For those who retire from the 13th month onwards from March 15, 2025, they will receive a subsidy of 0.5 of the level in Clause 1 of this Article.
Thus, the second case is that civil servants and public employees who retire early from the 13th month onwards from March 15, 2025 due to staff streamlining, restructuring and improving the quality of the team of cadres, civil servants and public employees will only receive 50% of the one-time pension allowance.
