YouMe Law Firm LLC said: According to Clause 2, Article 3 of Decree 73/2024/ND-CP stipulating the basic salary:
1. Basic salary used as basis:
a) Calculate salary levels in salary tables, allowance levels and implement other regimes according to law provisions for subjects specified in Article 2 of this Decree;
b) Calculate operating and living expenses according to the provisions of law;
c) Calculate deductions and benefits based on basic salary.
2. From July 1, 2024, the basic salary is VND 2,340,000/month.
The Government adjusts the basic salary after reporting to the National Assembly for consideration and decision in accordance with the State budget capacity, consumer price index and economic growth rate of the country.
Accordingly, from July 1, 2024, the basic salary is 2,340,000 VND/month. 2 cases of replacing the basic salary of 2.34 for cadres, civil servants, public employees and armed forces with different procedures:
Case 1: Replacing the basic salary of 2.34 million VND/month with another basic salary is approved with the following procedure:
The Government reports to the National Assembly for consideration of the new basic salary level, and decides in accordance with the state budget capacity, consumer price index and economic growth rate of the country.
After being considered and decided by the National Assembly, the Government will adjust the basic salary level.
Case 2: Replace the basic salary of 2.34 million VND/month with the basic salary in the new salary table, approved with the following order:
The Central Economic Commission presided over the preliminary review of the implementation of Resolution 27-NQ/TW in 2018, in which it coordinated with the Party Committee of the Ministry of Home Affairs and relevant ministries, branches and sectors to study and evaluate the suitability and feasibility and propose the implementation of 5 new salary scales of the public sector for submission to the Central Committee for consideration after 2026 when the Politburo promulgates and implements the system of Job Position Lists in the political system.
Thus, when salary reform occurs after 2026, the basic salary will be replaced by a basic salary equal to a specific amount in the new salary table.
