The Trade Union Law (amended) has just been passed by the National Assembly, effective from July 1, 2025. Article 10 of the law stipulates the following prohibited acts:
Article 10. Prohibited acts
1. Obstructing or causing difficulties in the exercise of trade union rights.
2. Discrimination against employees and trade union officials on the basis of establishing, joining or participating in trade union activities, including the following acts:
a) Request to join, not join or leave the Vietnam Trade Union in order to be recruited, sign or renew a labor contract or work contract;
b) Dismissal, discipline, unilateral termination of labor contracts, work contracts; not continuing to sign or renew labor contracts, work contracts; transferring employees to other jobs;
c) Discrimination in terms of wages, bonuses, benefits, working hours, and other rights and obligations in labor;
d) Discrimination based on gender, ethnicity, religion, belief and other discrimination in labor;
d) False information aimed at discrediting the reputation and honor of union officials;
e) Promise or provide material or non-material benefits so that employees or union officials do not participate in union activities, stop working as union officials or act against the Union;
g) Dominating, obstructing, or causing difficulties related to work in order to weaken trade union activities;
h) Other acts as prescribed by law.
3. Using economic measures, mental threats or other measures that are detrimental to the Trade Union organization, interfering with or manipulating the process of establishing and operating the Trade Union, weakening or neutralizing the performance of functions, tasks, rights and responsibilities of the Trade Union.
4. Failure to ensure conditions for trade union activities and trade union officials as prescribed by law.
5. Failure to pay union fees; late payment of union fees; payment of union fees not at the prescribed level; payment of union fees not for the required number of people; management and use of union fees not in accordance with regulations.
6. Receiving aid, sponsorship, or technical support contrary to the provisions of law.
7. Taking advantage of trade union rights to violate the law, infringe upon the interests of the State, the legitimate rights and interests of agencies, organizations, units, enterprises and individuals.
8. Untrue, provocative, distorted, or defamatory information about trade union organizations and activities.
The Trade Union Law currently in effect, Article 9, stipulates the following prohibited acts in trade union activities:
1. Obstructing or causing difficulties in the exercise of trade union rights.
2. Discrimination or adverse behavior against employees for reasons of establishing, joining or participating in trade union activities.
3. Using economic or other measures that are detrimental to trade union organizations and activities.
4. Taking advantage of trade union rights to violate the law, infringe upon the interests of the State, the legitimate rights and interests of agencies, organizations, enterprises and individuals.
