In which, the process and content of examination to detect occupational diseases are based on Article 9.
Article 9. Procedures and contents of occupational disease detection examination
1. Procedure for examination to detect occupational diseases:
a) Before examining and detecting occupational diseases, the employer or employee must send the medical examination and treatment facility a complete dossier according to the provisions of Article 8 of this Circular;
b) After receiving sufficient dossiers, the medical examination and treatment facility shall notify the time, location and other necessary contents related to the examination and detection of occupational diseases for employers or employees;
c) Performing first-time occupational disease examination and detection according to the provisions of Clause 2 of this Article;
d) At the end of the examination, the medical examination and treatment facility completes the examination book for occupational disease detection; summarize the results of the occupational disease detection examination according to the form specified in Appendix V attached to this Circular;
e) In case of being diagnosed with occupational disease, the medical examination and treatment facility must prepare a Certificate of occupational disease according to the form specified in Appendix VI issued together with this Circular and prepare a report on the case of a worker suffering from occupational disease according to the form specified in Appendix VII issued together with this Circular;
e) After organizing occupational disease examination and detection, within 20 days, the medical examination and treatment facility must return the results to the employer or the employee of the documents specified in Points d and d, Clause 1 of this Article.
2. Content of occupational medical examination:
a) Fully exploit personal information, current health status, medical history of individuals and families, time of exposure to harmful factors that may cause occupational diseases to record the occupational exposure history in the examination book for occupational disease detection;
b) Complete examination of the content according to the guidance on diagnosis and assessment of labor capacity reduction due to occupational diseases of the Minister of Health;
c) For female workers, they must be examined for obstetrics according to the regulations in Appendix VIII issued together with this Circular;
d) In case the employee has undergone periodic health check-ups, is issued a health certificate and is still valid according to the provisions of Circular No. 32/2023/TT-BYT, additional examinations of contents shall be performed according to the provisions of Point b of this clause;
e) For occupational diseases not on the list of occupational diseases entitled to social insurance, they must be fully examined in all specialties as prescribed by the doctor who is allowed to examine and treat occupational diseases in accordance with the law on medical examination and treatment.
