Article 52 of Decree 170/2025/ND-CP stipulates as follows: Resignation from office for civil servants in leadership and management positions
1. Consideration for resignation of civil servants holding leadership and management positions is carried out in the following cases:
a) Voluntarily ceasing to hold leadership or management positions;
b) Due to limitations in capacity or no longer enough health and reputation to fulfill assigned duties and tasks;
c) Causing serious violations by agencies, organizations, and units under the management and responsibility;
d) Having more than 50% but not more than 2/3 of the low votes of confidence at the voting period as prescribed by competent authorities;
d) For other legitimate reasons.
2. No civil servant holding a leadership or management position shall be considered for resignation if he/she falls under one of the following cases:
a) Taking on national defense and security tasks; Taking on important, covert tasks; preventing natural disasters and epidemics; if resigning immediately, it will seriously affect the common interests of the Party and the State;
b) While undergoing inspection or examination or being prosecuted, investigated, prosecuted, or tried.
