Ho Chi Minh City - Functional agencies in Ho Chi Minh City have worked and warned 100 units that are required to pay social insurance but have not participated.

Lai Thieu Base Social Insurance (HCMC) has reviewed the situation of compulsory social insurance contributions of units in 5 wards including: Thuan An, Thuan Giao, Binh Hoa, Lai Thieu and An Phu.

As a result, there are currently 34 units that are late in paying social insurance, health insurance, and unemployment insurance with a total late payment amount of over 74 billion VND. In addition, through data comparison with tax authorities, 100 units were identified as showing signs of being required to participate in social insurance, health insurance, and unemployment insurance but have not participated. This poses a risk of directly affecting the legitimate rights and interests of workers.

Lai Thieu Base Social Insurance also coordinated with the People's Procuracy of Region 16 to work with units that are late in payment and units that, through reviewing tax data, show signs of being required to participate in social insurance, health insurance, and unemployment insurance but have not participated.

The two units clarified the number of employees subject to participation, the amount of late payment and related contents for each enterprise. At the same time, guiding units to carry out procedures for registration to participate, post-payment, adjustment and remedy of shortcomings in accordance with the law. Requesting enterprises to seriously develop a roadmap for remedy, and sign minutes of commitment to fully fulfill their obligations.

Representatives of the People's Procuracy of Region 16 also analyzed the provisions of law related to the responsibility of employers; and clarified the legal consequences that may arise for acts of late payment and evasion of social insurance, health insurance, and unemployment insurance, emphasizing the sanctions according to the provisions of civil and criminal law and related regulations.

Lai Thieu Base Social Insurance said that in the coming time, it will continue to coordinate with the People's Procuracy of Region 16 to propagate, supervise and urge businesses to properly implement the provisions of law on social insurance, health insurance, and unemployment insurance. Thereby, promptly detect and prevent late payment, evasion of payment and non-participation for cases that are compulsory. The two units will also study and handle according to regulations for cases of intentional violations, contributing to protecting the legitimate rights and interests of workers.

According to records, the situation of late social insurance contributions of enterprises has seriously affected the rights of employees. There are cases where children are not entitled to maternity benefits, and there are cases where they are not entitled to health insurance payments when going for medical examination and treatment. Notably, there are cases where social insurance books cannot be finalized to continue participating in contributions at new units.
