Youme Law Firm LLC said that according to Article 3 of Decree 92/2025/ND-CP, it is stipulated that:
Regime and policies for senior experts who are cadres, civil servants, and public employees
The object specified in Clause 1, Article 2 of this Decree is holding the position of leadership, management of salaries according to the ranks, officials and civil servants, professional titles of officials and allowances for leadership positions or not holding the position of leadership or management as a senior expert, they should take on the old job position from the date of appointment of senior experts, lined up according to the salary of senior experts issued together with Decree No. 204/ND-2004 of the Government 14 Regarding the salary regime for cadres, civil servants, officials and armed forces (hereinafter referred to as salary of senior expert) and enjoy the following regimes and policies:
1. In case of holding a leadership or management position with a position allowance coefficient of 0.9 or lower or not holding a leadership or management position, the regime and policies are enjoyed, including:
a) Salary classification to level 1, salary coefficient 8.80 of the Senior Expert Salary Table;
b) Receive the regime and policies related to public service activities equivalent to the title of Assistant to senior leaders of the Party and State.
2. In case of holding a leadership or management position with a position allowance coefficient of 1.0 to 1.25, they are entitled to the regime and policies, including:
a) Salary classification to level 2, salary coefficient 9.40 of the Senior Expert Salary Table;
b) Receive the regime and policies related to public service activities equivalent to the position of Deputy Minister.
3. In case of holding a leadership or management position with a position allowance coefficient of 1.30 or higher, they will enjoy the regime and policies, including:
a) Salary classification to level 3, salary coefficient 10.0 of the Senior Expert Salary Table;
b) Receive the regime and policies related to public service activities equivalent to the title of Minister.
4. In case the new salary coefficient is lower than the total old salary coefficient (including salary coefficient according to rank, title plus leadership position allowance and seniority allowance exceeding the framework, if any), the reserve difference coefficient will be equal to the total old salary coefficient.
5. The agency employs senior experts based on the work efficiency of senior experts and the agency's resource capacity, it can implement a number of other regimes and policies (bonuses, working conditions, etc.) in accordance with the practical situation of the agency.
6.In case after stopping being a senior expert, the competent authority to manage and appoint cadres, civil servants and public employees into the new job position, based on the salary level at the civil servant rank, the professional title of the public employees who have enjoyed before appointing senior experts and the time to be a senior expert to arrange higher salaries in civil servants and professional titles of that public employee; Enjoy salary allowances (if any) attached to the new job position as prescribed.
Accordingly, senior experts who are civil servants and public employees not holding leadership or management positions are entitled to the following policies:
- Salary classification to level 1, salary coefficient 8.80 of the Senior Expert Salary Table;
- Receive the regime and policies related to public service activities equivalent to the title of Assistant to senior leaders of the Party and State.
