In particular, Article 14 clearly stipulates the level of benefits, procedures, and policies for people mobilized to participate in management and protection activities of national defense works and military zones that do not participate in social insurance but cause accidents or death while performing their duties.
Article 14. Benefits, order, procedures and responsibilities to ensure funding to pay for regimes and policies for mobilized people participating in management and protection activities of national defense works and military zones that do not participate in social insurance but are involved in accidents or die while performing their duties
1. Benefit level
a) During the period of accident treatment, all medical examination, treatment and daily food expenses are paid, including in case of recurrent wounds until health is stable and discharged from the hospital as for militia and self-defense forces;
b) In case of death, relatives are entitled to death benefits and funeral expenses as for militia and self-defense forces.
2. The dossier includes:
a) Application for accident benefits
Application for accident benefits (Form No. 03 in the Appendix to this Decree);
Hospital discharge paper or a copy of medical records after accident treatment for inpatient treatment or a copy of the injury certificate issued by the medical facility where the emergency was provided or treated;
Minutes of appraisal of the level of reduced working capacity of the Provincial Hospital Medical Appraisal Council and equivalent or higher; in case of a traffic accident, there will be additional minutes from the Police agency.
b) Application for death benefits and funeral expenses
Application for death benefits and funeral expenses (Form No. 03 in the Appendix to this Decree);
Hospital discharge paper or copy of medical records after accident treatment for inpatient treatment, copy of death certificate or death certificate; in case of traffic accident leading to death, there must be an additional record from the police agency.
3. The implementation sequence and processing time are according to the provisions of Clause 3, Article 13 of this Decree. In case the dossier components in Clause 2 of this Article have been digitized and stored in the Information System and Database of health agencies and police agencies, the requestor shall provide information in the request for the competent authority to resolve of the Provincial People's Committee and the Commune People's Committee to exploit online to resolve administrative procedures.
4. The cases specified in Clause 4, Article 13 of this Decree are not entitled to the subsidy regime if they have an accident or died.
5. The funding source for implementing the payment of the regimes and policies specified in this Article is guaranteed by the State budget.
