Article 13. Level of support, order, procedures and responsibility to ensure funding to pay for regimes and policies for people mobilized to participate in management and protection activities of national defense works and military zones who do not participate in health insurance but are sick, have an accident, or are injured while performing their duties
1. During the time participating in the management and protection of defense works and military zones, people mobilized when they are sick, have an accident, or are injured will be paid for all medical examination and treatment costs and receive daily food allowances during the period of inpatient treatment until their health is stable and they are discharged from the hospital as for militia and self-defense forces.
2. The dossier includes
a) Application for payment of medical examination and treatment costs for people receiving support for sick leave, accidents, injuries or legal representatives (Form No. 02 in the Appendix to this Decree);
b) Copies of receipts for money and discharge papers.
3. Implementation procedures and settlement time
a) Applicants who are supported with the sickness, accident, injury or legal representatives who prepare a set of documents as prescribed in Clause 2 of this Article must submit directly to the Provincial One-Stop Department, Commune One-Stop Department or submit online on the National Public Service Portal or the Provincial Administrative Procedure Information System or submit via public postal service;
b) The People's Committee (UBND) at the provincial level is responsible for assigning agencies and organizations to receive, if the dossier is complete, within 10 days to submit to the Chairman of the Provincial People's Committee to issue a decision on payment of medical examination and treatment support for people who are sick, have an accident, or are injured. In case the dossier is not complete or valid, there must be a Certificate of Instruction for supplementing and completing the dossier; the time for supplementing the dossier does not include the time for handling administrative procedures. In case the dossier components specified in Point b, Clause 2 of this Article have been digitized and stored in the Information System and Database of the health agency, the requestor or legal representative shall provide information in the request for the competent authority to exploit online to handle administrative procedures;
c) Within 3 working days from the date the Chairman of the Provincial People's Committee issues the decision to pay the fund, the People's Committee of the commune where the citizen registered his/her permanent residence is responsible for paying the cost of medical examination and treatment for the sick, accident victim, or injured; the payment is by bank transfer or by post or received directly at the paying agency.
4. People mobilized to participate in management and protection of defense works and military areas are not entitled to medical examination and treatment costs if they are sick, have an accident, or are injured in one of the following cases:
a) Intentionally destroying one's health;
b) Accidents for reasons not related to the performance of duties.
5. The funding source for implementing the payment of the regimes and policies specified in this Article is guaranteed by the State budget.
