On March 7, 2025, the Minister of Education and Training issued Circular 05/2025/TT-BGDDT regulating the working regime for general education and university residents. Accordingly, the regulations on annual leave for teachers from April 22, 2025 are as follows:
- Summer vacation time as prescribed in Point a, Clause 1, Article 3 of Decree 84/2020/ND-CP dated July 17, 2020.
During the summer vacation, teachers participate in training and fostering according to the requirements of the job position, participate in high school graduation exams, and enroll when called up by competent authorities;
- Holidays, Tet and other holidays as prescribed by the Labor Code and the Law on Social Insurance;
- Based on the school year plan, scale, characteristics, and specific conditions of each school, the principal arranges annual leave for teachers in accordance with regulations, ensuring the school year time frame.
One of the new points of Circular 05/2025/TT-BGDDT is the additional regulation on the rights of teachers on maternity leave, applied from April 22, 2025, specifically:
* In case the summer vacation and maternity leave of female teachers have the same period (other than holidays, Tet and other holidays as prescribed by the Labor Code and the Law on Social Insurance), the teachers' leave includes:
(i) Maternity leave as prescribed;
(ii) Summer vacation outside maternity leave (before or after maternity leave);
(iii) In case the summer vacation period prescribed in (ii) is less than the number of annual days off as prescribed by the Labor Code, teachers will have a number of additional days off.
The total number of additional days off and the number of days off as prescribed in (ii) are equal to the number of days off annually as prescribed in the Labor Code. Additional leave is flexibly arranged according to the agreement between the teacher and the principal.
* In case a male teacher is entitled to maternity leave when his wife gives birth according to the provisions of the Law on Social Insurance, during the leave, the male teacher's regime is calculated to meet the teaching period quota according to regulations and does not have to teach compensation.
In case the maternity leave when the male teacher's wife gives birth coincides with the summer vacation, there will be no compensatory leave.
